annually, after the adoption of such plan or program, the designated representative of Texas State <br />and the City Manager, or his or her designee, shall review the plan or program and make any <br />adjustments or modifications thereto as may be mutually agreed between them. <br />Section 2.02. Qualified Faculty Members. For purposes of this Agreement, faculty <br />members to which this Agreement shall apply are those employed as full-time tenured or tenure <br />line professors or full-time research professors who have not owned a home within the City of <br />San Marcos during the three (3) year period immediately preceding the date of closing on a home <br />for which down payment assistance is requested under the incentive program described in <br />Section 4.01 of this Agreement ("Qualified Faculty Members"). Qualified Faculty Members <br />must: a) remain continuously employed in the same or other Qualified Faculty Member position; <br />and b) maintain their primary residence in the City of San Marcos for a period of at least five <br />years from the date of being hired or contracted. <br />PART 3. TEXAS STATE TO PROMOTE RESIDENCY <br />Section 3.01. Promotion of City's Residency Program. In hiring Qualified Faculty <br />Members, Texas State agrees to promote a positive image of the City and the benefits of residing <br />in the City as follows: <br />a) Texas State shall provide information, training and/or education through <br />policy directives or other suitable form to all Texas State staff involved in direct <br />communication with applicants for Qualified Faculty Member positions to not <br />proactively discourage or steer away such applicants from residing in the City. This <br />subsection shall not be deemed to prohibit such Texas State staff from providing <br />information and personal opinions about the City as a place to reside in response to <br />inquiries from applicants. <br />Page 3 of 8
