not be modified or extended after the construction contract docmuents have been authorized by the <br />City to be competitively bid without written consent of the City and the Consultant and with notice <br />to the Contractor. <br /> <br />1.6 ADDITIONAL SERVICES <br /> <br />1.6.I Since the Engineer's fee is based upon hourly rates with a not to exceed amount, <br />compensation to the Engineer for additional services will only be for substantiaI deviations fi'om the <br />scope of services described in this Agreement. The Engineer ;vill submit a wa'itten estimate of fees <br />to the City and obtain the City's attthorization before initiating any additional services. The above <br />Basic Services do not include any of the Additional Services defined below: <br /> <br />g. <br /> <br />Obtaining rights-of-entry onto properties in the Project area. <br />Field survey of the boundaries of designated parcel easements. <br />Significant relocations of existing utilities. <br />Significant change in pipeline alignment after Task 2 - Preliminm'y Design. <br />Services of a resident project representative for the on-site observation of <br />construction. <br />Re-staking after initial staking foe design or construction phase. <br />Assistance to the City as an expert witness in any litigation with third parties arising <br />from the development or construction of the Project. <br />Detailed mill, shop and or laboratory inspection of materials or equipment. <br />Additional copies of reports and specifications and additional bluelines copies of <br />drawings over the agreed mtmbers described in the Basic Services. <br />Preparation of a Traffic Control Plan. Traffic control will be coordinated and <br />performed by the City and the Contractor. <br /> <br />1.6.2 Each material change (deletion or addition) in the services to be provided by Engineer must <br />be attthorized by the City on the Authorization of Change in Services form attached to this <br />Agreement as Attaclunent A. Compensation for additional Services will be in addition to that <br />specified for Basic Services in accordance with Section 5.2 of this Agreement. The approval of the <br />City's governing body is necessary for ail additional services when compensation exceeds $25,000. <br /> <br /> ARTICLE 2 <br />THE CITY'S RESPONSIBILITIES <br /> <br />The City will: <br /> <br />2.1 Provide fulI i~fformation to the Engineer regarding the City's requirements for the Engineer's <br />services trader this Agreement in tbe City's possession as needed by the Engineer at the Engineer's <br />request. <br /> <br />Byrn contract.wpd 8 <br /> <br /> <br />
