(b) Plat Approval. A preliminary plat and final plat for all or any portion of the Property <br />shall be approved by the City if such plat is in substantial compliance with the Governing <br />Regulations. Carma and the City agree that the approved land uses in each final plat of portions <br />of the Property shall be as specified on the Concept Plan, as may be amended from time to time <br />as provided in the PDD Regulations, unless otherwise mutually agreed upon by both the City and <br />Carma. <br />(c) Conflicts. In the event of a conflict between the LDC and the PDD Regulations, the <br />PDD Regulations shall control. In the event of any conflict between the LDC or the PDD <br />Regulations and any Approved Plat, the Approved Plat shall control. In the event of any conflict <br />between the LDC or the PDD Regulations and this Agreement, this Agreement shall control. <br />1.04 Other City Ordinances. Except as expressly excluded or made inapplicable by the <br />Governing Regulations or this Agreement, all other ordinances of the City shall apply to the <br />Property. <br />1.05 Enforcement. The Parties agree that the City shall be entitled to enforce all <br />applicable municipal land use and development regulations for the Property that are not in <br />conflict with the approved Governing Regulations and this Agreement in the same manner that <br />such land use and development regulations are enforced within the entirety of the City's <br />corporate boundaries. The City shall have the right to enforce the Governing Regulations and <br />this Agreement. <br />1.06 Streets. Except as provided by this Agreement or the Governing Regulations, or <br />as otherwise agreed to in writing by the Parties, to the extent any public streets are built within <br />the Project (hereinafter defined), the Parties agree that such streets shall be built to the City's <br />construction standards in effect on the Submittal Date. Except as may otherwise be agreed to in <br />writing by the Parties, all other streets or driveways shall be constructed in accordance with the <br />Governing Regulations. <br />Roadways proposed to extend beyond this Property shall afford access to the adjacent <br />properties. Right of way dedication for roadways proposed for extension beyond the Property <br />shall extend to the Property boundary and shall allow for public street, trail, sidewalk or bikeway <br />access to adjacent developed or undeveloped tracts. <br />Additionally, Carma and the City agree to the following with respect to the planned <br />minor arterial along the western boundary of the Property as shown on Exhibit I, attached hereto <br />(hereinafter "the Western Arterial "): <br />a. City, on some future date, may opt to purchase, condemn or otherwise acquire the <br />necessary right of way for the portions of the Western Arterial between the Property <br />and McCarty Lane (hereinafter "the McCarty Lane Segment ", as generally depicted <br />on Exhibit I); <br />
