b. If the City acquires the necessary right of way for the McCarty Lane Segment and upon platting for the 1726th dwelling unit for the Paso Robles Project, Carma agrees to: 1. Dedicate to the public at least 55 feet of right of way (but not more than 65 feet of right of way) for the portions of the Western Arterial within the Property north of the planned intersection with Centerpoint Road (said portion of the Western Arterial being hereinafter called the "Northern Segment" and being generally depicted as extending from Points A and B on Exhibit I) with the platting of adjacent lots; and 2. Construct two lanes of the Northern Segment. Carma shall only be obligated to construct two of the proposed four lanes of the Western Arterial. In the event City determines that two additional lanes are needed, City shall be responsible for all costs associated with acquisition of additional right of way and construction of the additional two lanes. c. Additionally, the City may opt on some future date to purchase, condemn or otherwise acquire the necessary right of way outside of the Property (hereinafter referred to as "the Posey Segment ") to connect the Northern Segment to that portion of the Western Arterial within the Property between Centerpoint Road and the southern boundary of the Property (said portion of the Western Arterial being hereinafter referred to as "the Southern Segment" and being generally depicted on Exhibit I as extending from Points E to Q. If the City does acquire the Posey Segment, Carma agrees to: 1. Dedicate to the public at least 55 feet of right of way (but not more than 65 feet) for the Southern Segment with the platting of adjacent lots; and 2. Upon the City indicating in writing a readiness to construct the portion of the Western Arterial within the Posey Segment, Carma shall construct two lanes of the Southern Segment between the Points E and D as shown on Exhibit I (approximately 2600 linear feet of roadway). Carma shall only be obligated to construct two of the proposed four lanes of the Western Arterial. In the event the City determines that two additional lanes are needed, City shall be responsible for all costs associated with the acquisition of additional right of way and construction of the two additional lanes. d. City and Carma agree that the location for the Western Arterial is subject to change in accordance to amendment of the City's Transportation Master Plan. In the event the location is changed, the City and Carma agree to work cooperatively to amend this agreement as necessary
