b. If the City acquires the necessary right of way for the McCarty Lane Segment and <br />upon platting for the 1726th dwelling unit for the Paso Robles Project, Carma agrees <br />to: <br />1. Dedicate to the public at least 55 feet of right of way (but not more than 65 <br />feet of right of way) for the portions of the Western Arterial within the <br />Property north of the planned intersection with Centerpoint Road (said portion <br />of the Western Arterial being hereinafter called the "Northern Segment" and <br />being generally depicted as extending from Points A and B on Exhibit I) with <br />the platting of adjacent lots; and <br />2. Construct two lanes of the Northern Segment. Carma shall only be obligated <br />to construct two of the proposed four lanes of the Western Arterial. In the <br />event City determines that two additional lanes are needed, City shall be <br />responsible for all costs associated with acquisition of additional right of way <br />and construction of the additional two lanes. <br />c. Additionally, the City may opt on some future date to purchase, condemn or <br />otherwise acquire the necessary right of way outside of the Property (hereinafter <br />referred to as "the Posey Segment ") to connect the Northern Segment to that portion <br />of the Western Arterial within the Property between Centerpoint Road and the <br />southern boundary of the Property (said portion of the Western Arterial being <br />hereinafter referred to as "the Southern Segment" and being generally depicted on <br />Exhibit I as extending from Points E to Q. If the City does acquire the Posey <br />Segment, Carma agrees to: <br />1. Dedicate to the public at least 55 feet of right of way (but not more than 65 <br />feet) for the Southern Segment with the platting of adjacent lots; and <br />2. Upon the City indicating in writing a readiness to construct the portion of <br />the Western Arterial within the Posey Segment, Carma shall construct two <br />lanes of the Southern Segment between the Points E and D as shown on <br />Exhibit I (approximately 2600 linear feet of roadway). Carma shall only <br />be obligated to construct two of the proposed four lanes of the Western <br />Arterial. In the event the City determines that two additional lanes are <br />needed, City shall be responsible for all costs associated with the <br />acquisition of additional right of way and construction of the two <br />additional lanes. <br />d. City and Carma agree that the location for the Western Arterial is subject to change in <br />accordance to amendment of the City's Transportation Master Plan. In the event the <br />location is changed, the City and Carma agree to work cooperatively to amend this <br />agreement as necessary <br />
