2019 (the "Term "). If, the Hays County Appraisal District notice of valuation for all personal <br />property on the Property sent to HELP in the last year of the Term is at least $30,000,000.00, <br />HELP may request an extension of the Term for an additional three years by providing written <br />notice thereof to the City at least 60 days before the expiration of the initial Term. <br />3.5. Annexation To the extent permitted by law, the City agrees to not initiate <br />annexation proceedings against the ETJ Tract or any portion of the ETJ Tract during the Term <br />and any extension of the Term, provided HELP is in compliance with this Agreement. <br />3.6. Certification Starting on or before February 1, 2011 and continuing until the <br />construction of the Project improvements is complete, HELP shall submit quarterly progress <br />reports to the City Manager describing the status of the Project and its efforts undertaken to effect <br />completion of construction. By January 30 of each year following completion of construction of <br />the Project improvements HELP shall submit to the City Manager a written statement, certified by <br />an authorized officer of the Affiliate, verifying that: <br />(a) the Property has continuously been used exclusively for the Project, or, if <br />not continuously used for the Project, what other uses have been allowed or interruptions <br />have occurred; and <br />(b) there have been no substantial changes in the operational activities on the <br />City Tract or any substantial alteration or removal of improvements, equipment, fixtures <br />and other taxable personal property on the City Tract, or if there have been any substantial <br />changes, alterations or removals, a description thereof (other than in the course of normal <br />operation and maintenance). <br />3.7 Proiect Name Beginning with the earliest of any ceremonial public <br />
