2) Assist in determining which utilities will be installed by "ROW -U- JUAB ", or by <br />"Agreement ". Process TxDOT form ROW -U -JUAB requests, utility agreements, <br />determine the necessity for any escrow agreements and forward to TxDOT for final <br />approval. <br />1.4.8 Utilitv Agreement Forms & Submission. Assist utility companies with an agreement <br />assembly submission for adjustments including applicable quit claims: <br />1) Review plans for compliance with UAR and verify that the Project will not conflict <br />with highway construction. <br />2) Determine whether a compensable interest exists and the owner's degree of eligibility <br />based on the submission of an easement document. Determine eligibility ratios; the <br />utility company must furnish a copy of the easement to prove eligibility. <br />3) Determine any betterments and betterment ratio. <br />4) Determine necessary documents conforming to the requirements of 23 C.F.R., <br />Section 645. <br />5) Review utility company estimates for relocation which will include totals for labor, <br />overhead, construction cost, travel, transportation, equipment, materials, supplies, and <br />other services. <br />6) Submit a copy of the assembly to TxDOT District Utility Coordinator by letter <br />recommending approval. <br />7) Maintain a complete set of records for utility adjustment costs for each Utility until <br />after final payment to Utility Companies /Owners has been made. <br />8) Coordinate with the City and TxDOT to acquire approval from TxDOT for a utility <br />company to select the lump sum account method for the reimbursement of utility <br />relocation costs. <br />9) Necessary transmittal documents to submit packages to TxDOT Division office. <br />1.4.9 Utilitv Acknowledgement. Submit non - reimbursable utility adjustments using the Utility <br />Joint Use Acknowledgement, Non - Reimbursable Utility Adjustment ( "ROW -U- JUAB ") form. <br />The term permit refers to form 1082 or form ROW -U -JUAB. Furnish the appropriate form to <br />the utility company and assist the company with adjustment plan preparation. The utility <br />company will submit the Utility Joint Use Acknowledgement and adjustment plans to the <br />Engineer for review. The Engineer will review plans for compliance with UAR and to verify that <br />the proposal will not conflict with highway construction. Utility companies that have facilities <br />within the project limits will be required to submit a Utility Acknowledgement Agreement even <br />if no conflicts occur and relocation is not necessary. <br />1.4.10 Escrow Agreements. If it is determined that a utility will be adjusted as part of the <br />Project, the Engineer will notify the City and TxDOT. In addition, the Engineer will assist in the <br />determination of the funding amount required based upon the: <br />1) <br />Applicable betterment; <br />2) <br />Eligibility ratio; <br />3) <br />LUP agreements; <br />4) <br />90/10 agreements; <br />HDR— Loop 82 Project Agreement <br />14 <br />
