<br />the proposition. <br /> <br />(2) The ballot cannot contain an indication of the effect that approval or disapproval <br />of a proposition will have on the position of the city council on any issue. <br /> <br />(3) The ordinance calling the election and the ordinance declaring the result of the <br />election must both contain a clear statement that the non-binding propositions are not binding <br />on the city council. <br /> <br />(4) The city council shall not place a non-binding proposition on a ballot as a <br />substitute or alternative for a binding proposition the council is obligated to place on the <br />same ballot. <br /> <br />(5) A non-binding proposition may be placed on the ballot by the council only when <br />the ballot will contain other matters. The city council shall not call an election at any time <br />solely for the purpose of placing one or more non-binding propositions before the voters of <br />the city. <br /> <br />MEASURE NO.5 <br /> <br />SHALL SECTION 7.02(4) OF THE CITY CHARTER BE AMENDED REGARDING THE <br />AUTHORITY OF THE PLANNING AND ZONING COMMISSION TO READ AS <br />FOLLOWS: <br /> <br />Sec. 7.02. Powers and duties of the commission. <br /> <br />The commission shall have the power and be required to: <br /> <br />******** <br /> <br />(4) Hold public hearings and approve or deny specific use permit applications made <br />under the city's zoning ordinance, subject to appeal of such decisions to the city council. The <br />council may sustain such an appeal and overturn a decision of the commission only by a <br />three- fourths vote of the council. <br /> <br />MEASURE NO.6 <br /> <br />SHALL SECTION 7.03 OF THE CITY CHARTER BE AMENDED REGARDING THE <br />CITY MASTER PLAN TO READ AS FOLLOWS: <br /> <br />Sec. 7.03. The master plan. <br /> <br />(a) The master plan for the City of San Marcos shall be used to guide the growth and <br />development of the city. The master plan shall be adopted by ordinance. The city council <br />will endeavor to ensure that city ordinances governing growth and development are <br />consistent with the goals and policies contained in the master plan; however, land use maps <br />and descriptions contained in the master plan do not constitute zoning, and do not entitle any <br /> <br />C:\TEMP\election 20022.doc <br /> <br />-3- <br />
