<br />1.3.3 Secure title insurance for all parcels acquired, insuring acceptable title to the City. With <br />written approval from the City for any exception. Cost of title insurance will be paid by the <br />City. <br /> <br />1.4 TASK 3 - RIGHT OF ENTRY AGREEMENTS <br /> <br />The Consultant will: <br /> <br />1.4.1 Secure rights of entry from designated property owners for the purpose of gaining access <br />for surveying, appraising, field inspection of right of way alignments, and other purposes as may <br />be determined. <br /> <br />1.5 TASK 4 - INITIAL APPRAISAL <br /> <br />The Consultant will: <br /> <br />1.5.1 Ensure that the appraiser is selected from the Texas Department of Transportation's <br />(TxDOT") list of state approved fee appraisers. The Consultant will secure written permission <br />from the property owner prior to entering the property which is to be acquired. If the Consultant, <br />after diligent effort, is unable to secure the necessary letter of permission from the property <br />owner, a waiver will be obtained, in writing from the City. <br /> <br />1.5.2 Keep and maintain permission letters with appraisal reports. <br /> <br />1.5.3 Prepare and conduct personal pre-appraisal contact with interest owner(s) of each parcel <br />using acceptable TxDOT forms. <br /> <br />1.5.4 Contact property owners or their designated representative(s) to offer the opportunity for <br />them to accompany the Consultant's appraiser during the appraisal of the subject property. <br />Keep record of every contact in files. <br /> <br />1.5.5 Prepare complete appraisal report for each parcel to be acquired utilizing TxDOT Forms <br />No. ROW-A-5, and ROW-A-I0. Consultant will ensure that these reports will conform to <br />TxDOT policies and procedures along with the Uniform Standards of Professional Appraisal <br />Practices. <br /> <br />1.5.6 As deemed necessary by the City and the Consultant, prepare written notification to the <br />City of any environmental concerns associated with the right-of-way to be acquired which may <br />require environmental remediation. <br /> <br />1.5.7 As deemed necessary by the City and the Consultant, arrange for the appraiser to appear <br />and/or testify as an expert witness in eminent domain proceedings and be available for pre- <br />hearing or pre-trial meetings as directed by the City. <br /> <br />3 <br />
