<br />1.9.13 Keep and maintain relocation contact logs on TxDOT form D-15-96. <br /> <br />1.9.14 Attend closings on replacement property if requested by any party involved, and assure <br />supplemental payment is properly distributed. <br /> <br />1.9.15 Process and compute increased interest payments as required. <br /> <br />1.9.16 When moves are $20,000 or less, the Consultant will submit a moving plan for the <br />business owner or tenant. <br /> <br />1.9.17 Be available for any appeals or hearings. <br /> <br />1.9.18 Prepare all relocation payment claim submissions for all displaced property owners for <br />each acquired parcel. <br /> <br />1.9.19 Deliver checks to property owners and/or tenants in accordance with TxDOT guidelines. <br /> <br />1.9.20 Issue relocation survey for each parcel to relocated/displaced property owners or tenants. <br /> <br />1.10 TASK 9 - CONDEMNATION SUPPORT SERVICES <br /> <br />The Consultant will: <br /> <br />1.10.1 Provide pre-hearing support to the City as follows: <br /> <br />a) Upon receipt of a copy of the final offer, request an updated title commitment from <br />the title company for use in the event of eminent domain proceedings. <br />b) Prepare a bisection clause for the original set of legal descriptions supplied by <br />TxDOT and the City. <br />c) Use the information from the Title Commitment to join all interested parties on <br />TxDOT Form RTE-49. Spouses of owners must be ioined. <br />d) Upon completion of the form RTE-49, prepare a packet containing 2 copies each of <br />the following documents: RTE-49 form, commitment, negotiator's reports, <br />appraisal acknowledgment, pre-appraisal contact sheet, signed and sealed property <br />description, and plat, final offer letter, any correspondence from the land owner or <br />representatives, along with one copy of the appraisal report. Submit packet to the <br />City, for use by City's legal counsel. <br />e) Upon receipt of concurrence from the City for the appraisal witness, request an <br />update of appraisal. <br />f) Upon receipt of packet prepared by the City's legal counsel which will include <br />the Petition for Condemnation, Lis Pendens, Order Appointing Commissioners, <br />Order Setting Hearing, Oath of Special Commissioner, and Notice of Hearings, <br />the Consultant will file the original petition with the Hays County Court at Law or <br />other appropriate court for a cause number to be assigned. <br /> <br />7 <br />
