He stated the <br />City will be able to monitor how the lights are performing and make sure <br />they remain synchronized. Mr. Thomaides stated the traffic lights in the <br />City are one of the top rated problems on the Citizen Survey and now they <br />are getting fixed. Mr. Taylor inquired as to the Memo dated April 22, <br />2005, regarding impacting 45 traffic signals instead of 59 traffic signals. <br />Mr. O'Leary stated there are 45 intersections involved and the 59 number is <br />the actual number of light signals. Laurie Anderson, Director of <br />Engineering, stated the Memo is to clarify how the signals are counted, and <br />there are 45 locations. She stated there are two intersections at each <br />location with multiple signals. Mr. Bose inquired as to the Attachment E. <br />Ms. Anderson stated the Uhland Road signal and the railroad crossing need <br />to coordinate, since there is not a crossing gate. She stated Staff <br />contacted TxDOT to see if there was a signal that would sense a train <br />coming and would coordinate with the Post Road traffic light turning red <br />and synchronize with the train signal in order to relieve Uhland Road <br />traffict. She stated TxDOT stated the City will need to work with Union <br />Pacific to install a train sensor on the railroad track. The Council then <br />voted unanimously for adoption of the Resolution. <br /> <br />Mayor Narvaiz introduced for consideration Item 14, removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE TERMS AND CONDITIONS OF A TAX ABATEMENT AGREEMENT <br />BETWEEN THE CITY AND LINCOLN/MFIL RED OAK, LTD. FOR NEW COMMERCIAL <br />RETAIL FACILITIES IN THE 2200-2300 BLOCKS OF IH-35 SOUTHi AUTHORIZING <br />THE CITY MANAGER TO EXECUTE THE AGREEMENTi AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Mr. Mihalkanin moved for adoption of the Resolution, and Mr. Thomaides <br />seconded the motion. Mr. O'Leary stated the City received a request from <br />Lincoln Properties for development incentives for a proposed commercial <br />retail facility on a 45 acre tract. He stated the Council directed Staff <br />to negotiate a Tax Abatement Agreement, which includes the following: 1. <br />Five year tax abatement for tax years 2007 through 2011, 2. Tax abatement <br />is on 100% of the value of improvements completed as of December 31, 2006, <br />and on increases in land value that occur after the agreement is executed, <br />and 3. No job requirement for job creation or maintenance is proposed. Mr. <br />Diaz inquired as to the road improvements in this area. Mr. O'Leary stated <br />the improvements to Leah Avenue are currently in the CIP with a small <br />amount of money set aside. He also stated the developers are responsible <br />for the road. The Council then voted unanimously for adoption of the <br />Resolution. <br />
