<br />Regular Meeting <br /> <br />May 17, 2005 <br /> <br />151 . <br />Page 7 <br /> <br />AYE: <br /> <br />Diaz, Guerrero, Narvaiz, Thomaides, Bose and Taylor. <br /> <br />NAY: None. <br /> <br />ABSTAIN: Mihalkanin (disclosure affidavit filed with City Clerk) . <br /> <br />Mayor Narvaiz introduced for consideration Item 20, removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING A LICENSE AGREEMENT BETWEEN THE CITY AND THE DOWNTOWN <br />ASSOCIATION OF SAN MARCOS, INC. FOR THE USE OF A PORTION OF AN ALLEY <br />EAST OF AND PARALLEL TO THE THREE HUNDRED BLOCK OF NORTH LBJ DRIVE i <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT i AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />Mr. Guerrero moved for adoption of the Resolution, and Mr. Mihalkanin <br />seconded the motion. Mr. Bose inquired whether the City has plans to <br />extend the pilot trash-compactor program to other alleyways in the City. <br />Mr. O'Leary stated this was a pilot program, which began because the <br />Downtown Association was trying to eliminate dumpsters in the alleyways and <br />place one electric-compactor dumpster for all the businesses to use <br />together. He also stated several businesses agreed to pay their pro-rata <br />share of the cost, which worked well in reducing the smell and the level of <br />trash in the area. He stated this agreement will allow the businesses to <br />continue the trash-compactor program. He also stated the City is currently <br />assisting the Downtown Association with looking at a similar arrangement in <br />the alleyways behind the fire station. He stated the key will be to get <br />all the businesses in the area to agree to sharing the cost of the <br />compactor. Mr. Diaz inquired whether the Downtown Association is looking <br />into the alley behind Goodyear and Paper Bear. Kelly Franks, Director of <br />Main Street, stated the consensus of the Downtown Association is to expand <br />this program into most of the alleyways in the downtown area. She stated <br />the Downtown Association is concerned about vehicle parking too close to <br />dumpsters, lack of parking and access for emergency vehicles. She stated <br />this program has worked so successfully that a number of businesses have <br />requested their alleys be considered to help eliminate problems. The <br />Council then voted unanimously for adoption of the Resolution. <br /> <br />Mayor Narvaiz introduced for consideration reconsideration of Item 10, <br />adoption of an Ordinance on third and final reading, adopted earlier on <br />consent, the caption which reads as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 2.213 OF THE CITY CODE TO REVISE THE ACTIVITIES AND <br />
