Ralph Wueller with TDS introduced Bryan Hobbs, Director of <br />Operations. Mr. Hobbs stated all the drivers have gone through extensive <br />training, revamped the driving procedures and added a spill kit to each <br />truck. Mr. Thomaides stated he feels the employees of TDS need to know <br />this pristine body of water is the most precious commodity to San Marcos. <br />Mayor Narvaiz thanked TDS for a job well done. <br /> <br />Mayor Narvaiz introduced for consideration a public hearing and adoption of <br />an Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 4.16 ACRE, <br />MORE OR LESS, TRACT OF LAND LOCATED AT 1803 HUNTER ROAD, FROM "PD" <br />PRE-DEVELOPMENT DISTRICT AND "C" COMMERCIAL DISTRICT TO "NC" <br />NEIGHBORHOOD COMMERCIAL DISTRICTi INCLUDING PROCEDURAL PROVISIONSi AND <br />PROVIDING FOR PENALTIES. <br /> <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Narvaiz closed the public hearing. Mr. Taylor <br />moved for adoption of the Ordinance, and Mr. Diaz seconded the motion. Mr. <br />Mihalkanin stated he has concerns with this rezoning. He stated the <br />minutes from the Planning and Zoning Commission show a concern with the <br />Purgatory Creek flooding. Carol Barrett, Director of Planning Department, <br />stated the development plans will be reviewed during the site plan stage. <br />She stated the applicant does not have to disclose their plans until the <br />next stage. Mr. Diaz stated he is concerned with this rezoning, because <br />when it rains the mobile home park in this area always floods. Mr. Bose <br />stated he has concerns with not being able to control Commercial Districts. <br />He also stated he feels quality of life is not being considered. Ms. <br />Barrett stated the Council can make a recommendation to amend the Land <br />Development Code to reflect controlling Commercial Districts. Mr. Guerrero <br />inquired as to the type business the applicant is proposing for this <br />location. Ms. Barrett stated she has been informed the applicant plans to <br />build offices. Mr. Thomaides stated the Planning and Zoning Commission did <br />not approve the original zoning. Ms. Barrett stated the original request <br />was Community Commercial. The applicant then changed the zoning to <br />Neighborhood Commercial, and the Commission unanimously approved the <br />zoning. Mr. Thomaides inquired as to the widening of Hunter Road. Laurie <br />Anderson, Director of Engineering, stated TxDOT proposes to build a bridge <br />at this location, which will split the floodway. She stated if building in <br />the 100 year floodplain is allowed, then there are specific procedures, <br />which must be followed. On roll call the following vote was recorded: <br /> <br />AYE: <br /> <br />Diaz, Guerrero, Narvaiz and Taylor. <br /> <br />NAY: <br /> <br />Mihalkanin, Thomaides and Bose. <br />
