• <br />Jean Baggett, 726 W. Hopkins, addressed the Council regarding the SmartCode. She referenced <br />Article #3 for community plans. She could never understand why T 1 -T3 was involved in the code <br />for downtown. She found out it was about the 40 acres option. She would like to see that dropped <br />because there is not 40 acres within the downtown boundaries. Ms. Baggett also referenced that <br />Article #4 is left blank, but it is still in there for future residential areas. She recommended dropping <br />it and pulling it out. She also stated that definitions are not clear, and that this could be manipulated <br />in many ways. Ms. Baggett asked to please use more concise language and suggested that the map <br />be an attachment to the code. <br />HC Kyle, 711 W. San Antonio, reported his concerns with the parking requirements of the <br />SmartCode, and asked that Council please check into it. <br />Diana Baker, 727 Belvin Street, stated that she is happy to see music at City Hall and believes that <br />art, architecture and music connect us. She went on to tell about how Charleston took a commercial <br />center and dumped it beside its historic downtown. Preservationists there love it and that it can be <br />used for conferences and festivals and everyone makes money. She explained that they added <br />architectural standards to their code and that is the secret to their success. Mrs. Baker feels that these <br />standards can still allow for choices and freedoms, and that we already have something special and <br />spiritual here and that we need build on it. <br />Fran Sherpa, 125 Edgemont Street, was happy to see that Riata Pass has withdrawn, but is sure they <br />will be back and doesn't know what they will ask for. At the last meeting she noticed the Mayor <br />suggested to the Council to look at what type of community they want to build and have in it. She <br />stated that San Marcos seems to be at a cross roads. She thanked the Mayor for his words. <br />9. Council Member Updates: <br />Receive status reports and updates from the Mayor and/or Council Members and a general <br />discussion regarding the following: <br />Mayor Guerrero — Update on the National Mayor's Conference and the National League of <br />Cities Conference. <br />Council Member Porterfield — Update on the Lone Star Rail District and the Hays Caldwell <br />Public Utility Agency. <br />Council Member Terry — Update on the CAPCOG Executive Committee. <br />MOTION: Upon a motion made by Council Member Porterfield and a second by Council Member <br />Thomason, the City Council voted (7) for and (0) opposed, to postpone item #9 until the next regular <br />meeting on April 19, 2011. The motion carried. <br />CONSENT AGENDA <br />10. Consider approval on second reading Ordinance 2011 -11 amending Section 2.566 of the <br />San Marcos City Code to authorize the City Manager to approve individual change orders in <br />amounts not to exceed $100,000 each in circumstances involving a public calamity, unforeseen <br />• damage to public machinery, equipment or property or when otherwise necessary to preserve <br />
