She stated she has filed <br />several petitions of protest, and there are more to come. 6) Jean Ferrell <br />stated she is the owner of 1406, 1408 and 1410 Franklin. She stated she <br />does not want the new zoning. 7) Derrick Demere stated he also agrees with <br />Jean Ferrell and feels the City should keep non-commercial. 8) George <br />VonderLippe stated he is a Heritage Neighborhood Officer. He thanked the <br />Planning Department for their hard work. He also stated he was grateful <br />for all the material and information he received at both Open Houses. He <br />stated he was concerned for the residents within 250 feet of the properties <br />with zoning changes. He stated none of the residents were notified of <br />these zoning changes. 9) Ana Martinez-Boling stated Ranch Road 12 is a <br />busy street and feels the neighborhood meets the zoning guidelines for MU. <br />10) Sandy Strickland stated she is opposed to the rezoning of 101 Hughson. <br />11) Pat Kelley stated she is the President of Franklin Homeowners <br />Association. She stated spoke with the Planning and Zoning Commission on <br />his neighborhoods concerns. She thanked the Planning and Zoning Commission <br />for their hard work. Mayor Narvaiz asked if anyone else wished to speak. <br />No one did, so Mayor Narvaiz closed the public hearing. Mayor Narvaiz <br />stated the Council received three legal protests. Mr. Thomaides stated he <br />would like to have more time to review this item. He expressed concern <br />regarding no notification to surrounding property owners and has an <br />interest in the normal zoning process being followed. He stated he wants <br />to review all properties where Staff and the Planning and Zoning Commission <br />differed. Mr. Mihalkanin stated he is willing to look at are the <br />properties where Staff and Planning and Zoning differed. The Council <br />concurred. Mr. Guerrero inquired about one of the properties that did not <br />meet the requirements for a legal protest. Andy Alarcon, Planning <br />Department, the request of Mr. Doehne is not appropriate for this process, <br />and Mr. Doehne needs to go through the normal zoning process. Mr. <br />Thomaides inquired whether properties being pulled can be sent back to <br />Planning and Zoning for the normal zoning process. Mr. Mark Taylor stated <br />the Planning and Zoning Commission makes recommendations to the Council. <br />The Council can then approve the Planning and Zoning Commission's <br />recommendations or deny them. He stated the only other choice the Council <br />has is to deny the Planning and Zoning Commission recommendation and leave <br />the old zoning in place, or recommend the Planning and Zoning Commission <br />reconsider the property to go through the normal process. Mr. Thomaides <br />inquired why notices were not sent to all residents within 200 feet of the <br />designated zoning. Mr. Mark Taylor stated the notice process was <br />determined by the Council in May. Mr. Guerrero stated he would like to <br />consider the thirteen properties separately, the Council concurred. The <br />Council also pulled properties numbered 51, 52, 126, 23, 32, 36, 37, 38, <br />66, 87, 89, 94, 101, 122 and 125. Mr. VonderLippe stated the Heritage <br />Association objects to 15, 16, 17, 27, 28, 29 and 30. Council agreed to <br />discuss these parcels also. Mr. Mihalkanin moved to approve the Ordinance <br />on first reading except for items numbers listed, and Mr. Guerrero seconded <br />
