Mayor Narvaiz stated a meeting could be scheduled. The <br />Council then voted unanimously for adoption of the Resolution. <br /> <br />Mayor Narvaiz introduced for consideration Item 16, removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN ADVANCE FUNDING AGREEMENT BETWEEN THE CITY AND THE STATE <br />OF TEXAS, ACTING THROUGH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR <br />THE STATE HIGHWAY 123/COUNTY ROAD 266 INTERSECTION IMPROVEMENTS <br />PROJECT; AUTHORIZING THE CITY MANAGER TO EXECUTE THIS AGREEMENT ON <br />BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Guerrero moved for adoption of the Resolution, and Mr. Taylor seconded <br />the motion. Mr. O'Leary stated this is an Advanced Funding Agreement for <br />the City to participate with TxDOT. He stated TxDOT is prohibited from <br />contracting directly with private development or the school district. He <br />stated funding for the construction project will come through three <br />sources, the developer of Cottonwood Creek subdivision, the City and <br />SMCISD/Hays County. He stated the funding source for the City's <br />participations come from reimbursement that the County paid the City for <br />the construction of Clovis Barker Road. The City portion of the project is <br />$300,000.00. He also stated as a result of TxDOT's reallocation and higher <br />construction prices, there is a shortfall in the construction. This <br />Interlocal Agreement is being modified through separate Council action to <br />address the shortfall, and upon receipt of the funds from SMCISD and/or <br />County, the account will be reimbursed. The Council then voted unanimously <br />for the adoption of the Resolution. <br /> <br />Mayor Narvaiz introduced for consideration Item 17, removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE TERMS AND CONDITIONS OF AMENDMENT NO. 1 TO THE <br />INTERLOCAL AGREEMENT BETWEEN THE CITY, HAYS COUNTY AND THE SAN MARCOS <br />CONSOLIDATED INDEPENDENT SCHOOL DISTRICT FOR FUNDING FOR IMPROVEMENTS <br />TO OLD BASTROP ROAD; AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />AMENDMENT; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Diaz moved for adoption of the Resolution, and Mr. Guerrero seconded <br />the motion. This amendment to the Interlocal Agreement is required to <br />address increases in project costs from the original agreement approved <br />last year. He stated this amendment revises the Interlocal Agreement to <br />address the shortfall. He stated Staff recommends the City consider <br />
