56. <br />Regular Meeting September 20, 2005 Page 9 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTIONS 1.4.3.6, 1.6.2.1, 1.6.2.6, 1.6.3.6, 1.6.4.6, <br />1.6.5.7, 1.6.6.7, 1.7.1.7, AND 1.8.1.7 OF THE CITY LAND DEVELOPMENT <br />CODE TO REVISE THE EXPIRATION PERIODS FOR UTILITY EXTENSION PETITIONS, <br />SUBDIVISION CONCEPT PLATS, PRELIMINARY SUBDIVISION PLATS, PRELIMINARY <br />DEVELOPMENT PLATS, FINAL SUBDIVISION PLATS, FINAL DEVELOPMENT PLATS, <br />CONSTRUCTION PLANS, WATERSHED PROTECTION PLANS, AND SITE PREPARATION <br />PERMITS; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Narvaiz closed the public hearing. Mr. Taylor <br />moved for approval of the Ordinance on first reading, and Mr. Diaz seconded <br />the motion. Mr. O'Leary stated the State Legislature recently adopted <br />Senate Bill 574, which changes the expiration dates for various development <br />processes and permits. He stated with the adoption of this Senate Bill, <br />the City needs to amend the Land Development Code to reflect the <br />requirements of the Law. He stated the Planning and Zoning Commission held <br />a public hearing and recommended approval of the amendments. Mr. <br />Mihalkanin inquired whether the City would be adding days to the platting <br />process. Mr. Mark Taylor stated the changes would be increasing the time <br />frame once a plat is filed. He stated the State changed the expiration of <br />applications from one year to two years. Mr. Taylor inquired whether the <br />applications currently in the process will be grandfathered. Mr. Mark <br />Taylor stated he would need to review the Bill, but the legislation become <br />effective when the Bill was signed by the Governor in May. He stated if <br />the application was filed before the end of April, then the old rules <br />apply. The Council then voted unanimously for approval of the Ordinance on <br />first reading. <br />Mayor Narvaiz introduced for consideration a public hearing and adoption of <br />an Ordinance, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP FROM LOW DENSITY <br />RESIDENTIAL TO HIGH DENSITY RESIDENTIAL FOR A 1.614 ACRE, MORE OR <br />LESS, TRACT OF LAND LOCATED AT 225 RAMSAY STREET; AMENDING THE <br />OFFICIAL ZONING MAP OF THE CITY BY REZONING THIS TRACT FROM "R-1" <br />SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY) TO "MF-18" MULTIPLE- <br />FAMILY RESIDENTIAL DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Narvaiz closed the public hearing. Mr. <br />Guerrero moved for adoption of the Ordinance, and Mr. Taylor seconded the <br />motion.
