1.2.1 Perform preliminary title searches, secure preliminary title report(s) and five -year sales <br />data from the title company providing title insurance. The City will pay the costs associated with <br />any preliminary title reports. <br />1.2.2 Secure title commitments and updates in accordance with insurance rules and <br />requirements for parcel payment submissions. <br />1.2.3 Secure title insurance for all parcels acquired, ensuring acceptable title to the City and <br />ensure that written approval is provided by the City for any exception. The City will pay the cost <br />of the title insurance. <br />1.3 TASK 3— APPRAISAL SERVICES <br />The Consultant will: <br />1.3.1 The Consultant will determine a recommended compensation estimate for the acquisition <br />parcels. If applicable, the Consultant will engage a fee appraiser and coordinate with the <br />appraiser regarding revisions, comments or additional information as may be required by the <br />City. The Consultant will provide quality control ( "QC ") review services of the appraiser's work <br />or licensed appraisal review services for the appraisal reports if requested, to determine <br />consistency of values, supporting documentation related to the conclusion and compliance with <br />the Uniform Standards of Professional Appraisal Practices. <br />1.3.2 Contact real property owners or their designated representative(s) to offer them the <br />opportunity to accompany the appraiser on the appraiser's inspection of the subject real property. <br />In addition, the Consultant will maintain record(s) of each such contact in parcel file for the <br />Project. <br />1.4 TASK 4— NEGOTIATION SERVICES <br />The Consultant will: <br />1.4.1 Contact and negotiate with each real property owner in an attempt to acquire the <br />necessary right -of -way and/or easement within 60 calendar days. On the first contact, the <br />Consultant will provide real property owners with the Texas Landowner's Bill of Rights. The <br />Consultant will initially ask the real property owners for a donation of the proposed right -of -way <br />and/or easement. At the City's discretion, the Consultant will tender a compensation amount to <br />the real property owner for settlement. The Consultant will utilize forms and documents <br />prescribed by the City in negotiations with all real property owners. In coordination with the <br />City, the Consultant will prepare the initial offer letter, a memorandum of agreement, <br />instruments of conveyance using the City's approved forms and any other documents required or <br />requested by the City for the City's review and approval. The Consultant will make at least three <br />attempts, in a timely manner, to initiate face -to -face contacts with real property owners living <br />within 50 miles of San Marcos. If the Consultant is not able to initiate face -to -face contact with <br />real property owners or owners live further than 50 miles from San Marcos, it will conduct <br />negotiations via telephone, fax, email or mail.
