<br />could be replaced with six 3-inch caliper trees, or nine 2~inch trees, or <br />any combination that totals 18 inches of replacement diameter. <br />2. Pruning a tree protected under the replacement rules does not <br />constitute removal. However, no more than 30% of the viable portion of <br />tree's crown may be removed. In addition 50% of the Critical Root Zone <br />must be protected from construction impact through the use of a barrier <br />fence. If either of these two provisions are exceeded, the tree is <br />considered removed and replacement is required if the tree is of <br />sufficient diameter. <br />3. All replacement trees must be a minimum of 2-inch caliper and must be <br />Class I Native Trees of the same species. To satisfy the replacement <br />requirement, the new tree(s) must be planted in POD parkland and <br />survive at least 3 (three) years after planting. <br />4. The San Marcos Parks Department will evaluate and measure trees prior <br />to removal as well as supervise the planting and maintenance of the <br />replacement trees. The construction contractor will be responsible for <br />planting and maintenance of trees during the first year. During the <br />second and third years after planting, tree maintenance will be periormea <br />by the San Marcos Parks Department. <br />6) The design of any bridge spanning the Blanco River will incorporate access for <br />pedestrian and bicycle traffic to provide a link to other portions of the City's <br />existing or proposed park system. Separated access from vehicular traffic is <br />recommended. <br />7) Any crossing of the Blanco River shall be a minimum of 150' downstream of <br />the existing island at the eastern extreme of Lot 9. The southern extent of the <br />island is defined as Point "Z" on Exhibit 'A' map. <br /> <br />C. Landscaping <br /> <br />I) Landscaping with locally adapted native Central Texas plants is encouraged to <br />reduce the water, fertilizer, and pesticide needs of the POD. Locally adapted <br />Central Texas native plants shall mean plants that would have occurred <br />naturally within one hundred (100) miles of San Marcos prior to European <br />settlement. <br />2) A sample native plant list is contained within Exhibit 'B'. <br />3) Plants listed within the current USDA listing of invasive plants shall not be <br />allowed within the PDD. <br />4) Plants listed within Exhibit "e' as locally invasive shall not be allowed within the <br />POD. <br /> <br />D. Public Areas <br />I) <br /> <br />If the City acquires Lot 4, or at the time of platting, access will be provided <br />through one of several possible routes. <br />2) Public use of Lots 5, 6, 7, and 8, along with the connecting trails adjacent to the <br />Blanco River shall be of a type and frequency as determined appropriate by the <br />City. If it becomes necessary to use portions of privately owned lot setbacks <br />for connecting trails, the City will formally indemnify the lot owner. <br />Use of land areas in Lot 9 shall be as a Nature Preserve with public access <br />limited to educational and research purposes. This is not, however, meant to <br />preclude public recreational use of the waterway.
