<br />for exercise and waste elimination must be secure and clean. <br /> <br />(Q) Subsections (a) and (b) of tIhis section does not apply to animal shelters, veterinary <br />establishments, government agencies or commercial animal establishments located on property <br />zoned for these purposes. Such establishments, however, must meet sanitation requirements and <br />keep all animals securely caged or penned. <br /> <br />Sec. 6.0813. Adoption program. <br /> <br />(a) Established. There is established an animal adoption program for the city. All persons <br />adopting animals from the city animal shelter will agree, prior to such adoption, to have the <br />animal spayed or neutered and to obtain the required rabies vaccination. Upon payment of all <br />adoption fees, a voucher will be issued which can be applied toward the cost of <br />spaying/neutering and vaccinations. <br /> <br />(b) Rules and regulations. The effief-animal control officer services manager will promulgate <br />rules and regulations pertaining to the operation of the animal control office's adoption program. <br />These rules and regulations will be made available to any person wishing to adopt any animal <br />from the city animal shelter. <br /> <br />(c) Fees. Fees for the adoption of animals from the city animal shelter are established by the city <br />council. A schedule offees is kept on file for public inspection in the office of the city secretary <br />and the animal control office. <br /> <br />Sec. 6.085. Animal care. <br /> <br />(a) Animal services staff members will respond to reports of insufficient animal care on a <br />complaint basis. <br /> <br />(b) It is unlawful for an animal owner or handler to fail to provide sufficient care for an animal <br />under his responsibilitv or control to maintain the animal in good health. A violation of this <br />subsection requires proof that an animal is not in good health. If an animal service staff member <br />investigating a complaint determines, in his or her professional opinion, that an animal is in good <br />health, the staff member will take no further action on the complaint. <br /> <br />(c) In determining whether an animal is in good health under subsection (b), animal services staff <br />members will investigate for signs that the animal is malnourished, dehydrated, ill or injured. <br /> <br />(d) Animal services staff members will use the following guidelines to determine whether an <br />animal is receiving sufficient care under subsection (b): <br /> <br />(1) A shelter should be provided for an animal if the animal is not given access to an <br />enclosed building, or if it is left outside unattended for long periods of time. The shelter should <br />provide an area for the animal that is dry and protected from pests and vermin and the elements. <br /> <br />11 <br />
