<br />No person shall expose any poisonous substance, whether mixed with food or not, so that the <br />substance is liable to be eaten by any animal. It is lawful for a person to expose, on his own <br />property, common rat poison mixed only with vegetable substance. <br /> <br />Sec. 6.008. Animal waste. <br /> <br />(a) Every owner or handler of any animal shall promptly, in a sanitary manner, remove and <br />dispose of excreta deposited by the animal on any public or private property, including the <br />property of the owner. <br /> <br />(b) lt is unlawful for any owner or handler of an animal to fail to keep the premises where the <br />animal is kept free from odors that are disturbing to any person residing within reasonable <br />proximity of the premises. <br /> <br />(c) It is unlawful to allow animals or premises where animals are kept to become infested with <br />fleas, ticks or other vermin, by failing to diligently and systematically apply accepted methods <br />of insect and parasite control. <br /> <br />Sec. 6.009. Duty of person striking animal with motor vehicle. <br /> <br />Any person who, as the operator of a motor vehicle, strikes any animal shall, as soon as <br />practicable, report the occurrence to the city animal shelter or police department. <br /> <br />Sec. 6.010. Animals received by animal shelter. <br /> <br />Any person who leaves an animal at the city animal shelter shall pay a drop-off fee established <br />by the city council. An exception to this section applies to animals delivered to the animal shelter <br />under an interlocal agreement. <br /> <br />Sec. 6.011. Compliance under chapter. <br /> <br />The keeping of any animal in accordance with this chapter shall not be construed to authorize <br />the keeping of the animal in violation of chapter 114 pertaining to zoning or any other city <br />ordinance. <br /> <br />Sec. 6.012. Bird Sanctuary. <br /> <br />(a) It is unlawful for a person to intentionally trap, hunt or shoot any wild bird or fowl, or to <br />intentionally destroy the eggs or nests of any wild bird of fowl in the city. <br /> <br />(b) It is an exception to the application of this section that the destruction of eggs or a nest occurs <br />as an unintended consequence of an otherwise lawful activity, such as the trimming or clearing <br />of trees or shrubbery. <br /> <br />6 <br />
