<br />(b) Council approval of a PDD application will result in a change in the base zoning designation <br />of the property on the official city zoning map, if a change in the base zoning was a part of the PDD <br />application, and the addition of "PDD Planned Development District" as an ioverlay over the <br />approved base zoning. Council approval will also result in approval and adoption of the land use <br />plan and development standards for the PDD. The zoning case number and the date of council <br />adoption will also be placed on the zoning map as a reference to the adopted land use plan and <br />development standards. <br /> <br />(c) The land use plan and development standards adopted as a part of the PDD zoning ordinance <br />will be binding features of the PDD zoning district for the property, enforceable as though a part <br />of regular zoning district regulations for the property. <br /> <br />(d) The applicant must submit a copy of the development standards for the PDD, executed and <br />acknowledged by the property owner, for recording by the city in the official records of the county <br />in which the property is located. The change in zoning for the property will take effect upon <br />recording of the development standards. <br /> <br />Sec. 94.233. Required building and site development permits; PDD site plan. <br /> <br />(a) After approval ofPDD zoning for a property, and prior to the commencement of construction <br />activities on the property, the owner or developer of the property must: <br /> <br />(1) submit a site plan for the property, or for the portion of the property being developed, <br />to the planning director, and obtain approval of the site plan from the planning director; and <br /> <br />(2) submit applications for, and obtain approval of, applicable site development permits. <br /> <br />(b) It is unlawful for any person to commence, or for an applicant or property owner to cause or <br />permit the commencement of, construction activities, including clearing, grading, filling, cutting <br />roads, or extending or installing utilities, on all or any portion of the property covered by an <br />approved PDD until the site plan and applicable site development permits have been applied for <br />and approved. If the construction is subject to building permit requirements, the applicant must <br />obtain approval of the site plan before a building permit can be issued for the property. <br /> <br />(c) The planning director will review the site plan submitted by the owner or developer of the <br />property, and determine whether it complies with the approved land use plan and development <br />standards, and with subdivision and base zoning regulations not otherwise expressly modified in <br />the applicant's land use plan or development standards. If the planning director determines that <br />the site plan adequately demonstrates such compliance, the director will approve the site plan. <br />Otherwise, the planning director will disapprove the plan and return it to the owner or developer <br />for revision. <br /> <br />(d) The applicant may request approval of minor modifications to the approved land use plan or <br />development standards for a PDD as a part of the submitted site plan. The planning director may <br />permit the applicant to make such minor modifications if the director determines that they do not <br />substantially impact compliance with the approved PDD.
