<br />Contractor; will issue final certificates for payment ortake other appropriate action; and will <br />make a written recommendation to the City regarding City's acceptance of the Project. <br /> <br />1.4.21 Interpret and decide matters concerning performance of the City and Contractor <br />under, and requirements of, the Contract Documents on written request of either the City <br />orthe Contractor. The Consultant's response to these requests will be made in writing with <br />reasonable promptness. Interpretations and decisions of the Consultant will be consistent <br />with the intent of and reasonably infer able from the Contract Documents and will be in <br />writing or in the form of drawings. The Consultant will render initial decisions on claims, <br />disputes or other matters in question between the City and the Contractor as provided in <br />the Contract Documents. However, the Consultant's decision on matters relating to <br />aesthetic effect will be final if consistent with the intent expressed in the Contract <br />Documents. <br /> <br />1.4.22 Require the submission by the Contractor, and subcontractors performing work on <br />the Project site, of periodic wage rate payment reports. The City will verify compliance with <br />federal and state wage rate requirements for the Project. The Consultant will notify the City <br />of the failure by the Contractor or subcontractor's to make submissions. <br /> <br />1.4.23 Review the set of reproducible record drawings as prepared by the General <br />Contractor showing significant changes in the work made during the construction phase, <br />and will submit them to the City for its records. <br /> <br />1.4.24 Ensure that all notices and signs required and provided by the City are posted in <br />the appropriate locations at the Project site by the Contractor. <br /> <br />1.4.25 Conduct final inspection with the City to check for conformance of the Project with <br />the requirements of the contract documents and to verify the accuracy and completeness <br />of the list submitted by the Contractor of work to be completed or corrected and to prepare <br />a punch list prior to final acceptance by the City. <br /> <br />1.4.26 When the Project is found to be substantially complete, the Consultant will inform <br />the City about the balance of the Contract Sum remaining to be paid to the Contractor, <br />including any amounts needed to pay for final completion or correction of the Project. <br /> <br />1.4.27 Receive from the Contractor and forward to the City: (1) consent of surety or <br />sureties, if any, to the making of final payment and (2) affidavits, receipts, releases and <br />waivers of liens or bonds indemnifying the City against liens. <br /> <br />1.4.28 Prior to the end of the one year warranty period, review the completed Project with <br />the City and the Contractor and have all deficient items corrected. The extent of the duties, <br />responsibilities and limitations of authority of the Consultant as the City's representative <br />during construction will not be modified or extended after the construction contract <br />documents have been authorized by the City to be competitively bid without written consent <br />of the City and the Consultant and with notice to the Contractor. <br /> <br />voelzel agrmnt revised.wpd <br /> <br />8 <br />
