Contractor; will issue final certificates for payment ortake other appropriate action; and will make a written recommendation to the City regarding City's acceptance of the Project. 1.4.21 Interpret and decide matters concerning performance of the City and Contractor under, and requirements of, the Contract Documents on written request of either the City orthe Contractor. The Consultant's response to these requests will be made in writing with reasonable promptness. Interpretations and decisions of the Consultant will be consistent with the intent of and reasonably infer able from the Contract Documents and will be in writing or in the form of drawings. The Consultant will render initial decisions on claims, disputes or other matters in question between the City and the Contractor as provided in the Contract Documents. However, the Consultant's decision on matters relating to aesthetic effect will be final if consistent with the intent expressed in the Contract Documents. 1.4.22 Require the submission by the Contractor, and subcontractors performing work on the Project site, of periodic wage rate payment reports. The City will verify compliance with federal and state wage rate requirements for the Project. The Consultant will notify the City of the failure by the Contractor or subcontractor's to make submissions. 1.4.23 Review the set of reproducible record drawings as prepared by the General Contractor showing significant changes in the work made during the construction phase, and will submit them to the City for its records. 1.4.24 Ensure that all notices and signs required and provided by the City are posted in the appropriate locations at the Project site by the Contractor. 1.4.25 Conduct final inspection with the City to check for conformance of the Project with the requirements of the contract documents and to verify the accuracy and completeness of the list submitted by the Contractor of work to be completed or corrected and to prepare a punch list prior to final acceptance by the City. 1.4.26 When the Project is found to be substantially complete, the Consultant will inform the City about the balance of the Contract Sum remaining to be paid to the Contractor, including any amounts needed to pay for final completion or correction of the Project. 1.4.27 Receive from the Contractor and forward to the City: (1) consent of surety or sureties, if any, to the making of final payment and (2) affidavits, receipts, releases and waivers of liens or bonds indemnifying the City against liens. 1.4.28 Prior to the end of the one year warranty period, review the completed Project with the City and the Contractor and have all deficient items corrected. The extent of the duties, responsibilities and limitations of authority of the Consultant as the City's representative during construction will not be modified or extended after the construction contract documents have been authorized by the City to be competitively bid without written consent of the City and the Consultant and with notice to the Contractor. voelzel agrmnt revised.wpd 8
