36. <br />Regular Meeting January 18, 2005 Page 8 <br />amendment will eliminate any mention of a supplemental service agreement <br />and special contract as referenced in the COGEN rate. He stated the City <br />had entered into a contract with Texas State University for a flat rate <br />and a kilowatt-per-hour rate, which ended and was not renewed. He stated <br />the University will now be a customer and pay a flat rate plus a kilowatt <br />charge. Mr. Thomaides inquired which classification the University is <br />classified in. Mr. O'Leary stated the City created a new classification, <br />which is like the contract the City had with the University. Mr. <br />Thomaides inquired whether the University was getting a better kilowatt- <br />hour rate than other San Marcos citizens. Mr. O'Leary stated the <br />University is a large customer, which uses a significant amount of <br />electricity and the cost would be more to service than a residential area, <br />so their overall rate is a little lower. He also stated the City has to <br />take a competitive position with the University as a customer, since they <br />have other electrical options. He stated the University could increase <br />their generation capacity on site and do more electric production <br />themselves, or the State Legislature could give the University the right <br />to buy from an open market. The Council voted unanimously for adoption of <br />the Ordinance on third and final reading. <br />Mayor Narvaiz introduced for consideration approval of the consent agenda <br />items not pulled to be considered separately (see Page 2) Mr. Thomaides <br />moved for approval of minutes of the Regular Meeting held January 4, 2005, <br />approval of three Ordinances on second reading, adoption of the remaining <br />three Resolutions, by consensus, and Mr. Guerrero seconded the motion, <br />which passed unanimously (Mr. Mihalkanin voted nay on Item #11, approval <br />of an Ordinance on second reading). The captions of the Ordinances and <br />Resolutions read as follows: <br />Approval of Ordinances on second reading: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 2.021 OF THE CITY CODE AND ADDING SECTION 2.022 OF <br />THE CITY CODE RELATED TO THE MUNICIPAL COURT; AND INCLUDING <br />PROCEDURAL PROVISIONS. <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 2.021 OF THE CITY CODE AND ADDING SECTION 2.023 OF <br />THE CITY CODE RELATED TO THE CITY CLERK; AND INCLUDING PROCEDURAL <br />PROVISIONS. <br />(Mr. Mihalkanin voting nay to the preceding Ordinance). <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE RELEASE OF AN ELECTRICAL EASEMENT LOCATED IN LOT 2, <br />GIL-MOR COMPANY SUBDIVISION LOCATED NEAR THE INTERSECTION OF STATE <br />HIGHWAY 123 AND INTERSTATE 35 TO THE PROPERTY OWNER, JUD'S FOOD <br />
