1 15 7 ProvIde admmIstratIOn of the constructIOn contract as set forth m the constructIOn documents unless otherwIse provIded m thIS Agreement and mcorporated m the constructIOn contract documents. Engmeer will not pursue a course of conduct WhICh mIght JeopardIze any of the CIty'S nghts thereunder Minor deViatIOns from the constructIOn contract documents that do not affect the valIdIty of performance bond(s) are permItted. 1 15 8 EstablIsh a system and set of procedures for 10ggmg, managmg, trackmg and stonng of all relevant correspondence and documents, RFI and Change Orders between the Contractor, Engmeer and CIty that are produced dunng the BId/Award, ConstructIOn and Close-out phases of the project. Engmeer WIll utIlIze an appropnate computer-based document management system selected by Engmeer The Engmeer WIll, m coordmatIOn WIth the CIty, mamtam hard copy records, sUItably orgamzed, of all relevant documentatIOn. The Engmeer wIll assIst the CIty m momtonng all outstandmg decIsIOns, approvals or responses reqUIred from the Engmeer or the CIty The Engmeer wIll reVIew each request for mformatIOn, mterpretatIOn and clanficatIOn of the constructIon contract documents ("RFI") submItted by the Contractor, wIll coordmate as needed wIth the City, and wIll Issue a response to the Contractor The Engmeer assumes that 120 RFIs wIll be submItted by the Contractor The Engmeer WIll reVIew each request of the Contractor for substItutIOn of matenals and eqUIpment, wIll reVIew the request and WIll advIse the City as to the acceptabIlIty of such substItutIOns, and wIll Issue a response to the Contractor 1 15 9 Be a representatIve but not an agent of the CIty dunng the constructIOn phase, and advIse and consult wIth the CIty and prOVIde progress reports and advIce to the CIty m wntmg; forward the CIty'S mstructIons to the Contractor unless (1) the Engmeer IS unaVailable by telephomc commumcatIon or otherwIse to Issue mstructIOns necessary for the proper progress and acceptance of work; (2) jeopardy to lIfe or property eXIsts, or (3) lack of mstructIOns or unaVailabIlIty of the Engmeer wIll result, m the CIty'S opmIOn, m harm to the City, m WhICh case mstructIOns may be forwarded dIrectly to the Contractor by the CIty; and have authonty to act on behalf of the CIty only to the extent prOVIded herem and m the constructIOn contract documents, unless otherwIse modIfied by wntten mstrument m accordance wIth SectIOn 12 1 Any mstructIons Issued dIrectly by the City to the Contractor WIll be promptly commumcated to the Engmeer If the Engmeer was unavaIlable at the tIme of Issuance of the mstructIOns. The Engmeer wIll Implement and mamtam regular communIcatIOns WIth the Contractor dunng the constructIOn. The Engmeer WIll receIve and log all commumcatIOns from the Contractor, and WIll coordmate the commumcatIOns between the City and the Contractor The Engmeer wIll not commumcate dIrectly wIth the Contractor's subcontractors. 1 15 10 Conduct a pre-constructIOn conference wIth the Contractor, members of the City staff (mcludmg CIty mspectors), representatIves of affected utIlIty prOVIders, and federal and state agenCIes havmg jUnSdIctIOn over the Project, m order to establIsh constructIOn schedules and to IdentIfy key representatIves of the partIes and lInes of commumcatIOn. 1 15 11 ASSISt the CIty m ensunng that all applIcable permIts and approvals have been 4 CH2M Hill WWTP Amdmt 1 1-18-05 (4)
