On the basIs of such on-sIte mspectIons by the Engmeer, the Engmeer wIll keep the CIty mformed of the progress and qualIty of the work through wntten status reports and through meetmgs wIth the City's representative, and wIll also be reasonably aVailable to perform SIte VIsItatIOns at the specIfic request of the CIty by the next busmess day after a request IS made. 1 15 13 Not have control or charge of and wIll not be responsible for constructIOn means, methods, technIques, sequences or procedures, or for safety precautIOns and programs m connectIOn wIth the work, for the acts or omISSIOns of the Contractor, subcontractors or any other persons performmg any of the work, or for the failure of any of them to carry out the work m accordance wIth the construction contract documents unless such acts or omISSIOns are due to the neglIgence of the Engmeer or are acts or omISSIOns under the Engmeer's control. However, the Engmeer wIll perform ItS duties hereunder, m partIcular dunng the constructIOn phase, m order to advIse the City If the Engmeer observes Contractor IS not completmg the Project m accordance wIth the constructIOn contract documents, and dunng any phase should the Engmeer become aware of the Contractor's utilIzatIOn of means, methods, technIques, sequences and/or procedures of constructIOn WhICh, m the Engmeer's opmIOn, wIll not result m completIOn of the Project m general accordance wIth the construction contract documents, or WhICh are unsafe, the Engmeer wIll ImmedIately mform the CIty and wIll take all necessary actIOn WhICh the Engmeer IS authonzed under thIS Agreement to take to correct the matter The Engmeer wIll mform the CIty and the Contractor of safety vIOlatIOns that It observes, but the Engmeer IS not responsible for Implementation of corrective actIOns by the Contractor or other entity or persons at the SIte except for Engmeer's own personnel. 1 15 14 At all times have access to the work wherever It IS m preparatIOn or progress. 1 15 15 ReceIve and reVIew the Contractor's requests for payment.
