<br />92. <br />Regular Meeting <br /> <br />December 7, 2005 <br /> <br />Page 10 <br /> <br />property as low density, but the next property owner might not Mr Diaz <br />stated this is a large corner lot with commercial zoning in the area He <br />also stated the Council cannot control what a property owner would do with <br />their property if it is allowed in a zoning category Mr Taylor inquired <br />as to when the Planning and Zoning Commission can be holding their retreat <br />Ms Barrett stated the retreat will be held in early 2006 She stated the <br />Planning and Zoning Commission could come back with different Mixed Use <br />categories, which could come back to the Council in April, 2006 Mayor <br />Narvaiz inquired if the Council chose to do a lateral zoning, would this <br />allow the property owner to come back in less than a year Mr Mark Taylor <br />stated Council could deny the MU zoning and the Planning and Zoning <br />Commission could change MU, then they would be able to come back He <br />stated a lateral zoning change would be the current zoning On roll call <br />for adoption of the Ordinance, the following vote was recorded <br /> <br />I <br /> <br />AYE <br /> <br />Taylor <br /> <br />NAY <br /> <br />Diaz, Guerrero, Mihalkanin, Narvaiz, Thomaides and Bose <br /> <br />ABSTAIN <br /> <br />None <br /> <br />The motion failed <br /> <br />Mayor Narvaiz introduced for consideration a public hearing and adoption ofl <br />an Ordinance, the caption which was read as follows <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP FROM LOW DENSITY <br />RESIDENTIAL TO MIXED USE FOR A 0 61 ACRE TRACT OF LAND LOCATED AT 1425 <br />RANCH ROAD 12; AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY <br />REZONING THIS TRACT FROM "R-1" SINGLE-FAMILY DWELLING DISTRICT (LOW <br />DENSITY) ("SF-6") TO "MU" MIXED USE DISTRICT, INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES <br /> <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak 1) Chris Murray stated he resides on Franklin Street He stated he <br />is opposed to the Mixed Use zoning He stated he moved to Franklin Street <br />because the surrounding area was zoned Single-Family and does not want the <br />potential of multi-family 2) Joe Cox stated he opposes the proposed <br />zoning Mayor Narvaiz asked if anyone else wished to speak No one did, <br />so Mayor Narvaiz closed the public hearing Mr Guerrero moved for <br />adoption of the Ordinance, and Mr Mihalkanin seconded the motion Mr <br />Mihalkanin stated many of the properties in the area are already zoned <br />Mixed-Use He stated he visited this property and there is an easement <br />which goes all the way to the cemetery Mr Thomaides stated he also <br />visited this property and understands the neighbors' concerns He stated <br />there is a privacy fence along one side of the property He stated he <br /> <br />I <br />
