<br />94. <br /> <br />Regular Meeting <br /> <br />December 7, 2005 <br /> <br />Page 12 <br /> <br />A valid petition required a super majority vote of the Council (6 votes) <br />approve the Planning and Zoning Commission's recommendation, so the <br />adoption of this Ordinance failed <br /> <br />tOI <br /> <br />Mayor Narvaiz introduced for consideration a public hearing and adoption of <br />an Ordinance, the caption which was read as follows <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN AMENDMENT TO THE FUTURE LAND USE MAP FROM LOW DENSITY <br />RESIDENTIAL TO MIXED USE FOR A 0 15 ACRE TRACT OF LAND LOCATED AT 512 <br />SAN ANTONIO STREET, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY <br />REZONING THIS TRACT FROM "MF-4" MULTI-FAMILY DWELLING DISTRICT (HIGH <br />DENSITY) ("MF-24") TO "DR" DUPLEX RESTRICTED DISTRICT; INCLUDING <br />PROCEDURAL PROVISIONS, AND PROVIDING FOR PENALTIES <br /> <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak No one did, so Mayor Narvaiz closed the public hearing Mr <br />Guerrero moved for adoption of the Ordinance, and Mr Taylor seconded the <br />motion Ms Barrett stated this rezoning is a reduction in density The <br />Council voted unanimously for adoption of the Ordinance <br /> <br />The Council agreed by consensus to convert all properties whose rezoning <br />requested were denied to Single-Family Dwelling District (SF-6) (on Pages I <br />6-12 of these minutes) <br /> <br />Mayor Narvaiz introduced for consideration Item 38 adoption of a <br />Resolution, the caption which was read as follows <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE CITY'S PARTICIPATION IN THE AUSTIN SAN ANTONIO <br />INTERMUNICIPAL COMMUTER RAIL DISTRICT, AND DECLARING AN EFFECTIVE <br />DATE <br /> <br />Mr Mihalkanin moved for adoption of the Resolution, and Mr Guerrero <br />seconded the motion Mr Guerrero moved to amend Part 3 to read John <br />Thomaides, an elected member of the City Council , and Mr Mihalkanin <br />seconded the motion, which passed unanimously The Council then voted <br />unanimously for adoption of the Resolution (Mr Taylor was present to <br />vote on this item ) <br /> <br />Mayor Narvaiz introduced Item 40, a discussion regarding proposal for <br />repair and stabilization of Rio Vista Dam Mr O'Leary gave a powerpoint <br />presentation regarding the condition of the dam He showed the cracks in <br />the dam, and area that has collapsed and separated from the dam Mr <br />O'Leary provided proposed repairs to the dam He stated an engineering <br />contract to review the repairs and cost to the dam could be agendized on <br />the next Regular Council Meeting scheduled for December 14, 2005 Tom <br /> <br />I <br />
