Both partIes understand that m SOlis, foundatIOn, groundwater, and other subsurface mvestIgatIOns, the actual charactenstIcs may vary SIgnIficantly between succeSSIve test pomts and sample mtervals and at locatIOns other than where observatIOns, exploratIOn, and mvestIgatIOns have been made Because of the mherent uncertamtIes m subsurface evaluatIOns, changed or unantIcIpated underground condItIons may occur that could affect the total ProJect cost and/or executIon. Such changed condItIons and cost/executIOn effects are not the responsibIlIty of the Engmeer 1 3 5 Based on the approved PrelImmary DeSIgn TechnIcal Memorandum, and any further adJustments m the scope, schedule, or qualIty of the ProJect or m the constructIOn budget authonzed by the City, the Engmeer WIll prepare, for approval by the CIty and Operator, detaIled plans, drawmgs, deSIgns, layouts and speCIficatIOns settmg forth m detail the reqUIrements for the constructIOn of the ProJect. The Engmeer wIll use ItS best profeSSIOnal Judgment to create documents that comply WIth applIcable laws, constructIon and development codes, local regulatIons, and ordmances and other federal and state regulatIOns whIch are known or whIch should reasonably be known to the Engmeer NotwIthstandmg the CIty'S approval of the documents, Engmeer warrants that the drawmgs and speCIficatIOns WIll be suffiCIent and adequate to fulfill the purposes of the ProJect. In addItIon, the Engmeer WIll develop constructIon sequence speCIficatIOns. The CIty and Operator WIll prOVIde comments to the Engmeer on eqUIpment Items that the Engmeer IS to speCIfy 1 3 6 ASSISt the City m the preparatIon of constructIOn contract documents usmg CIty forms based on the approved deSIgn development documents and any further adJustments authonzed by the City m the scope, qualIty or budget of the ProJect. These contract documents wIll mclude detaIled plans and techlllcal speCIficatIOns reqUIred for the ProJect to be accurately bId and effiCIently constructed. 1 3 7 Ensure that no reports, maps, or other documents produced m whole or m part under thIS Agreement wIll be the subJect of an applIcatIOn for copynght by or on behalf of the Engmeer 1.3 8 AdVIse the CIty and Operator of any adJustments to the OpmIOn of Probable ConstructIon Cost mdIcated by changes m reqUIrements or general market condItIons m a further detailed statement. 1 3 9 ASSISt the CIty m connectIon WIth the CIty'S responsibIlIty, If any, for filmg documents reqUIred for the approval of governmental authontIes havmg JunsdIctIon over the ProJect.
