r-----m-- I I I neglIgence of the Engmeer or are acts or omISSIOns under the Engmeer's control However, the Engmeer wIll exerCIse ItS authonty on behalf of the CIty m accordance hereWIth and partIcularly dunng the constructIOn phase so that all work performed by the Contractor results m a ProJect completed m accordance WIth the constructIOn contract documents, and dunng any phase should the Engmeer become aware of the Contractor's utIlIzatIOn of means, methods, technIques, sequences and/or procedures of constructIOn WhICh, m Engmeer's opmIOn, WIll not result m completIon of the ProJect m accordance WIth the constructIOn contract documents, or WhICh are unsafe, the Engmeer WIll ImmedIately mform the CIty and wIll take all necessary actIOn WhICh the Engmeer IS authonzed under thIS Agreement to take to correct the matter 1 4 12 At all tImes have access to the work wherever It IS m preparatIOn or progress 1 4 13 Determme the amounts owmg to the Contractor based on ItS on-SIte profeSSIOnal mspectIons and on evaluatIOns of the Contractor's applIcatIOns for payment mcludmg compansons of Contractor's monthly cost reports WIth ItS applIcatIOns for payment, and wIll make recommendatIOns for payment m these amounts, as proVIded m the constructIOn contract documents, or take such other appropnate actIon WhICh the Engmeer deems necessary 1 4 14 Make recommendatIons for payment that constItute a representatIOn by Engmeer to the City, based on the Engmeer's on-SIte mspectIOns as prOVIded m subsectIOn 1 4 10 and on the data compnsmg the Contractor's applIcatIOn for payment, that the work has progressed to the pomt mdIcated, that, to the best of the Engmeer's knowledge, mformatIOn and belIef, the qualIty of the work IS m acceptable conformance WIth the constructIOn contract documents (subJect to an evaluatIOn of the work for conformance WIth the constructIOn contract documents upon substantIal completIOn, subJect to the results of any subsequent tests reqUIred by or performed under the constructIon contract documents, subJect to mmor vanatIOns from the constructIOn contract documents correctable pnor to completIOn, and subJect to any speCIfic qualIficatIOns stated m the CertIficate for Payment), and that the Contractor IS entItled to payment m the amount certIfied. The Engmeer WIll reVIew the work and results of all testmg laboratones as reqUIred by the constructIOn contract documents. 1 4 16 ReVIew and make all declSlons regardmg the approval or takmg of other appropnate actIOn upon the Contractor's submIttals, mcludmg but not lImIted to, shop drawmgs, product data and samples, schedule of values and progress schedule Such actIOn WIll be taken WIth reasonable promptness, but generally not to exceed 15 days or such penod of tIme as wIll not cause delay of the ProJect.
