Austin, the Hays County Criminal District Attorney's Office, the Hays County Sheriff's <br />Office, and the City of San Marcos; such approval is contingent upon the Citv of San <br />Marcos' receipt of Asset Forfeiture Funds in an amount sufficient to meet the City's <br />$32,517.67 financial obligation under the Interlocal Agreement for the remainder of the <br />2011 -2012 Fiscal Year and upon approval of a budget amendment authorizing the <br />expenditure of such funds for that purpose; and declaring an effective date. <br />13. Consider approval of a motion that authorizes Mayor Daniel Guerrero to sign and issue <br />a letter to the Texas Department of Transportation regarding the acceptance for Local <br />Maintenance and Operation of portions of Loop 82. <br />MOTION: Upon a motion made by Council Member Terry and a second by Council Member <br />Prather, the City Council voted (7) for and (0) opposed, to approve the consent agenda except for <br />items # 11, 12, and 13 which were pulled to be considered separately. The motion carried <br />unanimously. <br />(11) MOTION: Upon a motion by Council Member Thomason and a second by Council <br />Member Porterfield the City Council voted (7) for and (0) Opposed, to approve Resolution 2011 - <br />148R, as previously captioned. The motion carried unanimously. <br />(12) MOTION: Upon a motion made by Council Member Scott and a second by Council <br />Member Porterfield the City Council voted (6) for and (1) abstained, Council Member Prather, to <br />approve Resolution 2011 -149R, as previously captioned. The motion carried. <br />(13) MOTION: Upon a motion made by Council Member Scott and a second by Council <br />Member Porterfield the City Council voted (7) and (0) opposed, to approve the authorization for <br />Mayor Daniel Guerrero to sign and issue a letter to the Texas Department of Transportation <br />regarding the acceptance for Local Maintenance and Operation of portions Loop 82. The motion <br />carried unanimously. <br />PUBLIC HEARINGS <br />14. 7:OOPM Receive a Staff presentation and hold a public hearing to receive comments for <br />or against Ordinance 2011 -71 authorizing the abandonment of an unimproved portion of <br />Advance Street between the lots at 800 and 804 Bishop Street; approving the conveyance of <br />this abandoned street section pro rata to the owners of abutting lots; authorizing the City <br />Manager to execute deeds to such abutting lot owners upon payment of the fair market <br />value of said abandoned street section; and declaring an effective date; and Consider <br />approval of Ordinance 2011 -71. <br />Matthew Lewis, Development Services Director, provided Council with a brief presentation on <br />the abandonment of an unimproved portion of Advance Street. <br />Following the presentation Mayor Guerrero opened the Public Hearing at approximately <br />7:10 p.m. <br />
