<br />To be eligible for reimbursement of approved equipment items, PERFORMING AGENCY must <br />order the equipment and incur the costs of these items before the end of the Attachment term. The <br />invoiced equipment item(s) shall be received and paid for by PERFORMING AGENCY no later <br />than 90 days following the end ofthe Attachment term. If requested by RECEIVING AGENCY, <br />PERFORMING AGENCY shall forward proof of payment and a copy of the shipping invoice <br />showing the delivery date of any item(s) that were claimed for reimbursement by this method. <br /> <br />General Provisions, Advance Payments Article, is not applicable to this Attachment. <br /> <br />General Provisions, Program Income Article, is not applicable to this Attachment. <br /> <br />General Provisions, Equipment and Supplies Article, fourth paragraph, is replaced with the <br />following: <br /> <br />PERFORMING AGENCY shall maintain a property inventory and submit a Report of Tangible <br />Nonexpendable Property (TDH Form GC-11) to RECEIVING AGENCY no later than 45 days <br />following the completion of installation. PERFORMING AGENCY shall administer a program <br />of maintenance, repair, and protection of assets under this Attachment so as to assure their full <br />availability and usefulness. In the event PERFORMING AGENCY is indemnified, reimbursed, <br />or otherwise compensated for any loss of, destruction of, or damage to the assets provided under <br />this Attachment, it shall use the proceeds to repair or replace said assets. <br /> <br />General Provisions, Reports Article, second paragraph, is replaced with the following: <br /> <br />PERFORMING AGENCY shall submit the following report not later than 90 days following the <br />completion of installation: <br /> <br />· Report for Advance or Reimbursement, Form 270 (TDH Form GC-10); <br /> <br />PERFORMING AGENCY shall submit quarterly (or a different frequency specified in writing by <br />RECEIVING AGENCY) program progress reports (Form 87a) covering the PERFORMING <br />AGENCY'S activities under this Attachment, <br /> <br />General Provisions, Client Records Article, is not applicable to this Attachment. <br /> <br />General Provisions, Confidentiality Article, is not applicable to this Attachment. <br /> <br />General Provisions, Termination Article, is amended to include the following: <br /> <br />Notwithstanding the foregoing provisions, at any time, PERFORMING AGENCY may, in its sole <br />discretion, determine to discontinue fluoridation. If PERFORMING AGENCY determines to <br />discontinue fluoridation, its sole obligation hereunder shall be to notify RECEIVING AGENCY <br />of its decision within 30 days and make available to RECEIVING AGENCY for pick-up by <br /> <br />A TT ACHMENT - Page 4 <br />
