There being no comments, the Public Hearing was closed at 7:21 p.m <br />MOTION: Upon a motion made by Council Member Thomason and a second by Council <br />Member Terry, the City Council voted (7) for and (0) opposed, to approve Resolution 2011 - <br />159R, as previously captioned. The motion carried unanimously. <br />21. 7:OOPMReceive a Staff presentation and hold a public hearing to receive comments for <br />or against Ordinance 2011 -77 approving an amendment to the Future Land Use May from <br />"LDR" Low Density Residential to "C" Commercial for a 2.119 acre, more or less, tract of <br />land located at 1620 Old Ranch Road 12; amending the Official Zoning Map of the City by <br />rezoning this tract from "SF -6" Single - Family Residential District to "NC" Neighborhood <br />Commercial District; and including procedural provisions; and consider approval of <br />Ordinance 2011-77. <br />Matthew Lewis, Development Services Director, provided a presentation. <br />Following the presentation Mayor Guerrerro opened the Public Hearing at approximately 7:28 <br />p.m. <br />Thomas Rhodes, ETR Development, explained the location. Planning and Zoning requested they <br />reduce from community commercial to neighborhood commercial. This will require an <br />additional Commercial Use Permit. The Request was favorable. <br />Brenda Smith, 610 Old Ranch Road 12, opposes this zoning change. She noted a for sale sign <br />has been posted on this property for some time and no buyers have shown interest. When the <br />City widens Craddock it will be at the detriment of the tax payers. Ms. Smith pointed out the <br />application. <br />Jane Hughson, 1600 N. LBJ, stated that anyone has the right to submit applications, but it is the <br />duty of the Council to protect the Community. She continued by reading from the Horizons <br />Master Plan. <br />Diane Wassenich, 11 Tanglewood, opposes any zoning that would be allowed to operate in the <br />evening hours. This is backed up to a residential neighborhood. An office would be a better <br />alternative. Single family homes are not being protected. <br />Ed Theriot, ETR Development, Right of Way has been acquired from this property. <br />Neighborhood commercial is designed to provide service to the neighborhoods. <br />Joe Schneider, 803 Mustang Lane, would like to see an entire block of neighbors. <br />The Public Hearing was closed at 7:40 p.m. <br />MOTION: Upon a motion made by Council Member Terry and a second by Council Member <br />Porterfield, the City Council voted (5) for and (2) opposed, Council Members Prather and <br />Thomason, to approve Ordinance 2011 -77, as previously captioned.
