On roll call the following vote was <br />recorded: <br /> <br />AYE: Diaz, Guerrero, Narvaiz, Thomaides, Bose and Taylor. <br /> <br />and <br /> <br />NAY: <br /> <br />None. <br /> <br />ABSTAIN: Mihalkanin (disclosure affidavit-business entity filed with the <br />City Clerk) <br /> <br />Mayor Narvaiz introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE GRANTING OF THREE EASEMENTS TO GUADALUPE-BLANCO RIVER <br />AUTHORITY IN CONNECTION WITH GBRA'S IH-35 WATER TRANSMISSION MAIN <br />PROJECTi AUTHORIZING THE CITY MANAGER TO EXECUTE THE EASEMENTSi AND <br />PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Taylor moved for approval of the Ordinance on first reading and Mr. <br />Diaz seconded the motion. Mr. Mihalkanin inquired whether the City would <br />Ihave to have a reason to say no to give up easements. Jan Clark, <br />Assistant City Attorney, stated the City does not have to have a reason to <br />say no. Mr. Taylor inquired whether the Council can give up easements of <br />property which is dedicated parkland. Mr. O'Leary stated the City Charter <br />has restrictions on conveyances of parkland. He stated the Council cannot <br />negotiate a voluntary grant of easement with GBRA for parkland. He stated <br />this easement will be approved as an involuntary conveyance under threat <br />of eminent domain. He also stated staff has recommended accepting the <br />$5,953.00 as compensation for this conveyance. The Council then voted <br />unanimously for approval of the Ordinance on first reading. <br /> <br />Mayor Narvaiz introduced for consideration reconsideration of a Zoning <br />Ordinance. The Council did not wish to reconsider this Ordinance.
