<br />118. <br />Regular Meeting <br /> <br />November 22, 2004 <br /> <br />Page 6 <br /> <br />CURRENT MEMBERS OF THE LIBRARY BOARD AND THE <br />COMMISSION; AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />PLANNING AND <br /> <br />ZONING <br /> <br />I <br /> <br />Mr. Diaz moved for approval of the Ordinance on first reading, and Mr. <br />Mihalkanin seconded the motion. On roll call the following vote was <br />recorded: <br /> <br />AYE: <br /> <br />Diaz, Guerrero, Mihalkanin, Narvaiz, Bose and Taylor. <br /> <br />NAY: Thomaides. <br /> <br />ABSTAIN: None. <br /> <br />Mayor Narvaiz introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ADOPTING A NEW CITY OF SAN MARCOS LAND DEVELOPMENT CODE, INCLUDING <br />CHAPTER 1, DEVELOPMENT PROCEDURES, CHAPTER 2, DEVELOPMENT IN THE <br />EXTRATERRITORIAL JURISDICTION, CHAPTER 3, COMPREHENSIVE PLANNING, <br />CHAPTER 4, ZONING REGULATIONS, CHAPTER 5, ENVIRONMENTAL REGULATIONS, <br />CHAPTER 6, DEVELOPMENT STANDARDS, CHAPTER 7, PUBLIC FACILITIES <br />STANDARDS, AND CHAPTER 8, DEFINITIONS; MAKING FINDINGS IN CONNECTION1 <br />WITH THE ADOPTION OF THE LAND DEVELOPMENT CODE; AUTHORIZING THE <br />PROMULGATION OF A TECHNICAL MANUAL AND OTHER TECHNICAL REFERENCES BY <br />THE CITY STAFF; PROVIDING FOR PENALTIES; AND INCLUDING PROCEDURAL <br />PROVISIONS. <br /> <br />Mr. Mihalkanin moved for approval of the Ordinance on first reading and <br />Mr. Taylor seconded the motion. Mayor Narvaiz stated several citizens <br />have signed up to speak on this Ordinance. 1) Curtis Seebeck stated he is <br />President of the Hays County Chapter Homebuilders Association of Austin. <br />He provided the Council with a letter of comments for consideration before <br />the third and final reading of the Land Development Code. He stated he <br />feels parkland should apply to waterways. He stated he also feels <br />invasive tree species such as juniper, chinaberry and ligustrum should not <br />be protected under any circumstances. 2) Harry Savio stated he is a <br />member of the Homebuilders Association of Austin. He stated he feels the <br />lnsurance bonds may rule out small contractors, who are unable to get a <br />bond. Ed Theriot, Chief Planner, stated the Land Development Code process <br />began six years ago with a Development Ordinance Task Force. He stated <br />Council then hired a consultant, which provided a draft of the Code in <br />April. He stated thirty public hearings were held, and meetings with <br />developers and property owners were also held. He stated the Land <br />Development Code combines eighteen City Codes, which will reduce the I <br />inconsistencies in the development process. The Council then voted <br />unanimously for approval of the Ordinance on first reading. <br />
