<br />5.4 Acquire all land and rights-of-way required <br />for the PROJECT and any related off-site work, if any. <br /> <br />5.5 Respond promptly in writing to requests by <br />the CONSULTANT for authorization to proceed with specific <br />activities deemed desirable and as set forth hereinbefore. <br /> <br />5.6 The OWNER agrees to require a provision in the <br />construction contract documents to the effect that the <br />contractor will hold harmless the CONSULTANT for the <br />acts of employees or representatives of the OWNER and <br />contractor. Further, the OWNER agrees to require the <br />contractor to obtain contractor's liability insurance, <br />with the OWNER and CONSULTANT named insured in the policy. <br /> <br />ARTICLE 6 <br /> <br />SPECIAL CONSIDERATIONS <br /> <br />6.1 OWNERSHIP OF DOCUMENTS <br /> <br />6.1.1 After completion of the PROJECT the original <br />drawings, as modified to show construction, will be deliver- <br />ed to the OWNER, and will become the OWNER'S property. <br /> <br />6.2 AUDIT <br /> <br />6.2.1. The OWNER, the Federal Aviation Administration, <br />the Comptroller General of the United States or any of their <br />duly authorized representatives shall have access to any <br />books, documents, papers, and records of the CONSULTANT <br />which are directly pertinent to the project, for the purpose <br />of making aduits, exams, excerpts, and transcriptions. <br />CONSULTANT shall maintain records for three (3) years <br />following final payment by OWNER. <br /> <br />ARTICLE 7 <br /> <br />CONTROL BY OWNER <br /> <br />7.1.1 It is understood and agreed that the OWNER <br />shall have complete control of the services to be rendered, <br />and that no work shall be done under this contract until <br />the CONSULTANT is instructed in writing to proceed with <br />the work, except that the execution of this contract shall <br />serve as authority to proceed with the work included in <br />Phase 1. <br /> <br />-10- <br />
