97 THE STATE OF TEXAS AGREEMENT OF LEASE COUNTY O~ CALDWELL KNOW ALL MEN BY THESE PRESENTS: That the City of San Marcos, Texas, a municipal corporation existing by and under the laws of the State of Texas, acting through authority conferred on its Mayor, Emmie Craddock, by Resolution duly adopted on August 9 , 1982, hereinafter "City", and Butternut Electronics Company, Inc., hereinafter "Company", enter into this lease of a portion of the San Marcos Municipal Airport. WITNESSETH 1. City is the owner of the San Marcos Municipal Airport by virtue of an indenture from the united States of America dated the 14th day of February, 1966, the 14th day of July, 1969, and the 11th day of May, 1976, to which reference is hereby made and by such reference, made a part thereof. City hereby leases unto Company a portion of said Airport for the purpose of manufacturing and selling radio antennas. City hereby leases and Company here- by rents the premises on which is located building No.6-356, said building containing approximately 3,520 square feet of floor space. Said lease shall also include the area immediately surrounding said building for a total lease of 23,814 square feet. Company agrees at its sole expense to have an exact survey made of said premises. The survey shall be made a part of this Agreement. II. As consideration and rental for the demised premises, Company agrees to pay to City the sum of ten cents (10~) per square foot for the first year of the Agreement, payment to be made in advance on the date of execution of this lease by Company. Company further agrees that consideration and rental for the demised premises for each additional year shall be set annually by agreement of the parties prior to the month and day on which the agreement is executed by Company. Subsequent payments shall be made annually in advance on the same date as the first payment.
