<br />97 <br /> <br />THE STATE OF TEXAS <br /> <br />AGREEMENT OF LEASE <br /> <br />COUNTY O~ CALDWELL <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />That the City of San Marcos, Texas, a municipal corporation <br /> <br />existing by and under the laws of the State of Texas, acting through <br /> <br />authority conferred on its Mayor, Emmie Craddock, by Resolution <br /> <br />duly adopted on August 9 <br /> <br />, 1982, hereinafter "City", and Butternut <br /> <br />Electronics Company, Inc., hereinafter "Company", enter into this <br /> <br />lease of a portion of the San Marcos Municipal Airport. <br /> <br />WITNESSETH <br />1. <br /> <br />City is the owner of the San Marcos Municipal Airport by <br /> <br />virtue of an indenture from the united States of America dated <br /> <br />the 14th day of February, 1966, the 14th day of July, 1969, and <br /> <br />the 11th day of May, 1976, to which reference is hereby made and <br /> <br />by such reference, made a part thereof. City hereby leases unto <br /> <br />Company a portion of said Airport for the purpose of manufacturing <br /> <br />and selling radio antennas. City hereby leases and Company here- <br /> <br />by rents the premises on which is located building No.6-356, <br /> <br />said building containing approximately 3,520 square feet of floor <br /> <br />space. Said lease shall also include the area immediately <br /> <br />surrounding said building for a total lease of 23,814 square feet. <br /> <br />Company agrees at its sole expense to have an exact survey made <br /> <br />of said premises. The survey shall be made a part of this Agreement. <br /> <br />II. <br /> <br />As consideration and rental for the demised premises, Company <br /> <br />agrees to pay to City the sum of ten cents (10~) per square foot <br /> <br />for the first year of the Agreement, payment to be made in advance <br /> <br />on the date of execution of this lease by Company. Company further <br /> <br />agrees that consideration and rental for the demised premises for <br /> <br />each additional year shall be set annually by agreement of the <br /> <br />parties prior to the month and day on which the agreement is executed <br /> <br />by Company. Subsequent payments shall be made annually in advance <br /> <br />on the same date as the first payment. <br />
