<br />17 <br /> <br />THE STATE OF TEXAS <br /> <br />AGREEMENT TO LEASE <br /> <br />COUNTY OF CALDWELL <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />This agreement pertains to the agricultural use of certain <br /> <br />lands, herein described, located at the San Marcos Municipal <br /> <br />Airport (formerly identified as Camp Gary), situated in Caldwell <br /> <br />County, Texas. The agreement is made and entered into by and <br /> <br />between the City of San Marcos, Hays County, Texas, herein called <br />consisting of Harrell Tietjen and Curly D. Ohnheiser, <br /> <br />Lessor and 'l'ietjenjOnnheiser, a partnership/ herein called Lessee. <br /> <br />The accompanying map and "Airport Drainage Study" from the <br /> <br />Airport Master Plan are made parts of this lease agreement. <br /> <br />I. <br />DESCRIPTION OF DEMISED PROPERTY <br /> <br />The demised property is divided into three (3) tracts as <br /> <br />described below and identified on the accompanying map. This <br /> <br />division into tracts is made for the purpose of identifying the <br /> <br />allowable use of each tract. <br /> <br />TRACT A. Tract A consists of 248 acres more or less, <br />that are immediately adjacent to the runways and <br />taxiways at the airport. More particularly, it <br />is situated parallel to and 300 feet distant from <br />the center line of each and every runway and 50 feet <br />from each taxiway center line and it extends 400 <br />feet from the end of each and every runway, between <br />parallel lines of equal width with the width of <br />the runways. Additionally it includes all of the <br />land bounded on the sides by concrete apron and <br />the segments of runways 8-26 and 12-30 closest thereto, <br />and on the ends by taxiways A and E as shown on the <br />land use map. <br /> <br />TRACT B. Tract B consists of 193 acres more or less, <br />and is that area situated outside the boundaries <br />of Tract A, but it enclosed entirely by runways or <br />a combination of runways and taxiways. <br /> <br />TRACT C. Tract C consists of 459 acres more or less, <br />which constitute all other agricultural lands located <br />at the airport not contained within the boundaries <br />of Tract A or B. <br /> <br />II. <br />CARE AND USE OF DEMISED PROPERTY <br /> <br />TRACT A. This tract constitutes a part of the runway <br />
