17 THE STATE OF TEXAS AGREEMENT TO LEASE COUNTY OF CALDWELL KNOW ALL MEN BY THESE PRESENTS: This agreement pertains to the agricultural use of certain lands, herein described, located at the San Marcos Municipal Airport (formerly identified as Camp Gary), situated in Caldwell County, Texas. The agreement is made and entered into by and between the City of San Marcos, Hays County, Texas, herein called consisting of Harrell Tietjen and Curly D. Ohnheiser, Lessor and 'l'ietjenjOnnheiser, a partnership/ herein called Lessee. The accompanying map and "Airport Drainage Study" from the Airport Master Plan are made parts of this lease agreement. I. DESCRIPTION OF DEMISED PROPERTY The demised property is divided into three (3) tracts as described below and identified on the accompanying map. This division into tracts is made for the purpose of identifying the allowable use of each tract. TRACT A. Tract A consists of 248 acres more or less, that are immediately adjacent to the runways and taxiways at the airport. More particularly, it is situated parallel to and 300 feet distant from the center line of each and every runway and 50 feet from each taxiway center line and it extends 400 feet from the end of each and every runway, between parallel lines of equal width with the width of the runways. Additionally it includes all of the land bounded on the sides by concrete apron and the segments of runways 8-26 and 12-30 closest thereto, and on the ends by taxiways A and E as shown on the land use map. TRACT B. Tract B consists of 193 acres more or less, and is that area situated outside the boundaries of Tract A, but it enclosed entirely by runways or a combination of runways and taxiways. TRACT C. Tract C consists of 459 acres more or less, which constitute all other agricultural lands located at the airport not contained within the boundaries of Tract A or B. II.
