<br />-7- <br /> <br />injury or death to anyone person; up to $300,000 for each occur- <br /> <br />rence; and $100,000 for damage to property; and such insurance <br /> <br />policy shall contain the endorsement that such insurance may not <br /> <br />be cancelled or amended with respect to Lessee without ten (10) <br /> <br />days written notice by registered mail to Lessor by the insurance <br /> <br />company; and that Lessor shall not be required to pay any premiums <br /> <br />for insurance. Any insurance policy herein required or procured <br /> <br />by Lessee shall contain an express waiver of any rights of subroga- <br /> <br />tion by the insurance company against the Lessor. A copy of any <br /> <br />such insurance policy shall be delivered by Lessee to Lessor with- <br /> <br />in ten (10) days of the inception of such policy by the insurance <br /> <br />company. The minimum limits of any insurance coverage required <br /> <br />herein shall not limit Lessee's liability under Part VII of <br /> <br />this Agreement. <br /> <br />XI. <br />INDEHNIFICJl.TION <br /> <br />Lessee agrees to indemnify and hold harmless Lessor from <br /> <br />all damages, claims, losses, demands, suits, judgments, costs, <br /> <br />including reasonable attorney's fees, and expenses arising out <br /> <br />of or resulting from the use of the demised premises for agricultural <br /> <br />purposes by <br /> <br />LeS2ee <br /> <br />, provided that any such <br /> <br />claim is caused in whole or in part by any negligent act or omission <br /> <br />of Lessee, regardless of whether it is caused in part by Lessor. <br /> <br />Said indemnification shall occur whenever said negligent act or <br /> <br />omission is that of Lessee, anyone directly or indirectly e8- <br /> <br />ployed by Lessee or anyone for whose acts Lessee may be liable. <br /> <br />Lessee shall defend any litigation in connection with the use <br /> <br />of said demised premises for agricultural purposes by <br /> <br />Lessee. <br /> <br />XII. <br />CONSERVATIOH PHACTICES <br /> <br />Lessee agrees to operate all the lands described by this <br /> <br />lease agreement in such a manner as to preserve and maintain <br /> <br />and improve the structure and fertility of the soil by using <br />
