<br />I <br /> <br />I <br /> <br />I <br /> <br />of the approach to construction selected by the City, the Project is completed in a manner that <br />ensures integration of the Instream Work and Bank Work components, and functionality and <br />durability of the overall Project. <br /> <br />1.1.4 The Engineer certifies that it has special expertise in the area of dam repair and hydraulic <br />modeling. <br /> <br />1.1.5 The Engineer represents that it is familiar with environmental laws generally, and with the <br />federal Endangered Species Act in particular. The Engineer acknowledges that the site of the <br />Project is in an area of the San Marcos River with a high level of environmental sensitivity. The <br />San Marcos River in this area is fed almost entirely by constant-temperature natural springs from <br />the Edwards Aquifer that are located about one mile from the site of the Project. In this area, the <br />San Marcos River is inhabited by three animal species and one plant species that are listed as <br />endangered or threatened under state and federal laws, and the river is designated as critical <br />habitat under federal law for these species. The Engineer understands and agrees to provide all of <br />its services with due regard for the environmental sensitivity of the site of the Project. <br /> <br />1.1.6 The Engineer's Basic Services consist ofthe services described in Sections 1.1 through 1.4 <br />and includes normal civil engineering services. <br /> <br />1.1.7 The performance of all services by the Engineer in connection with this Agreement will <br />be by persons appropriately licensed or registered under State, local and Federal laws governing <br />their respective consulting disciplines. In performing all services under this Agreement, the <br />Engineer will use that degree of care and skill ordinarily exercised for similar projects by <br />professional Engineers who possess special expertise in the types of services involved under this <br />Agreement. <br /> <br />1.1.8 No work under this Agreement will be subcontracted by the Engineer without prior <br />written approval from the City. Any work or services subcontracted under this Agreement shall <br />be specified by separate written Agreement and shall be subject to each provision of this <br />Agreement. <br /> <br />1.1.9 Any provisions in this Agreement pertaining to the City's review, approval and/or <br />acceptance of written materials prepared by the Engineer and/or its subconsultants, contractors, <br />and subcontractors in connection with this Agreement will not diminish the Engineer's <br />responsibility for the materials. <br /> <br />1.1.10 Engineer will perform all of its services in coordination with the City. The Engineer will <br />advise the City of data and information the Engineer needs to perform its services, and the <br />Engineer will meet with City representatives at mutually convenient times to assemble this data <br />and information. <br /> <br />Ham Prof Services <br /> <br />2 <br />
