<br />E. PROPRIETARY INFORMATION: This RFP constitutes proprietary information. Any <br />use of this format or material other than for response to this proposal is strictly prohibited I <br />without written consent of the City and CCG. <br /> <br />F. LOBBYING PROHIBITED: Potential proponents are prohibited from directly or <br />indirectly communicating with City Council members regarding the proponent's <br />qualifications or the award of a contract. Potential proponents are prohibited from <br />contacting City staff members regarding their qualifications or the award of a contract, <br />unless in response to an inquiry from a staff or committee member. Any violation will result <br />in immediate disqualification of the proponent from the selection process. <br /> <br />G. CITY ARTWORK: Use of the City logo on proposals is not permitted. <br /> <br />H. PERMITS AND FEES: Proponent will procure and pay for all permits and fees which <br />are required for installation and implementation of all materials and labor necessary for this <br />project, and will give all notices and comply with all laws, regulations, rules and ordinances. <br /> <br />I. REPORTS. RECORDS. AND DATA: Proponents may be asked to submit periodic <br />progress schedules, reports, estimates, records, and other data concerning project. <br /> <br />J. SUBCONTRACTORS: If a subcontractor performs any portion of the equipment or <br />cable installation, the successful proponent will submit subcontractor information for <br />approval by the City and CCG before subcontractor will be allowed to commence any I <br />portion of the work. The successful proponent agrees to be fully responsible to the City for <br />all subcontractor employees. All subcontractors are to be paid in full by successful <br />proponent prior to system acceptance by the City. <br /> <br />K. PERSONNEL CHANGES/CONFLICTS: All personnel assigned to this project will <br />remain assigned for project duration, unless the person leaves employment of proponent <br />or unless the City requests a change of personnel. The City reserves the right to discharge <br />proponent's personnel from site if, in City's sole discretion, representative is deemed <br />incompetent, negligent, offensive or has engaged in misconduct. The proponent agrees <br />that the City and CCG will not be liable for any damage or cause of action arising from <br />dismissal of proponent's personnel and agrees to indemnify, defend and hold harmless, <br />the City and CCG, for causes of action or damages brought by proponent's personnel <br />against the City and CCG which arise out of such removal. <br /> <br />L. INSPECTIONS AND CLEANUP: The proponent will, at its' own expense, take every <br />precaution against damage to property, building apparatus, materials, supplies, and <br />equipment in an orderly fashion at the work site so as not to interfere with work progress of <br />any other contractors; to clean up frequently all refuse, scrap and debris resulting from <br />installation of services in a neat and orderly condition. The City and CCG will approve site <br />condition prior to final payment. If, after 24 hours' notice by the City and CCG, the <br />successful proponent has not diligently proceeded with cleanup or repair, then the City will <br />proceed with cleanup and/or repair at successful proponent's expense. The successful I <br />proponent will not place, cause or permit to be placed or disposed, any hazardous <br />substance as defined by applicable environmental laws.
