2. At the Developer's option, separate sub - associations may be created in different <br />areas of the Project. <br />3. Except as otherwise permitted in this PDD, each property owner in the Project <br />shall be a member of one of the Property Owners' Associations which shall collect fees <br />from each property owner for payment for the following common services: landscaping, <br />promotions and events, cleaning, security, marketing, architectural control and project <br />administration. <br />4. If a property owner fails to timely pay its association fees, the Property Owners <br />Association's declaration of covenants shall enable it to file a lien against that owner's <br />property. <br />2.3.4. Architectural Control Committee <br />1. The Developer must create one or more Architectural Control Committees as part <br />of the CCRs for the Property, which shall be funded by the Property Owners Associations <br />(as applicable). <br />2. The Developer or other person proposing the construction of a building must <br />submit architectural drawings including proposed size, elevations, percentage of <br />masonry, and overall home design for approval from the Architectural Control <br />Committee charged with reviewing such plans. <br />3. All building exteriors, site plans and signage and environmental graphic designs <br />must be approved by the Architectural Control Committee prior to approval of a building <br />permit by the City. The Developer or other person proposing the construction of a <br />building shall present a copy of the written approval of the Committee at the time of <br />submission of a building permit application to the City. <br />2.3.5. Street Lights in Public ROW. The Developer may, with the written approval of the <br />Director, incorporate alternative lighting standards in the public rights -of -way designed to aesthetically <br />enhance the Property. <br />2.3.6. Fences and Gates <br />1. The maximum height of an Open Style Fence in a street yard shall be forty-two <br />(42) inches. Masonry columns are permitted as part of all Open Style Fences. <br />2. Privacy or security fences up to six foot (6') in height are permitted along the <br />side yards. Six foot (6') privacy fences are not permitted to extend into a front yard <br />setback or comer side setback. Open picket fences are also permitted alongside yards or <br />between buildings or along the outer perimeter of the Mixed Use Area. <br />3. Fences that abut Parks and Alleys shall be Open Style Fences and /or privacy <br />fences up to four feet (4') in height. <br />4. Where an alley is provided adjacent to lots in the Low Density Residential Area <br />and such lots have fences adjacent to the alley, a pedestrian passageway, or gate, shall be <br />provided from the rear or side yard to the alley of such lots. <br />2.3.7. Building Limitation and Requirements to the Low Density Residential Area (base <br />zoning: SF4.5 single family). <br />Minimum lot area: <br />A. Internal: 4,000 square feet <br />B.
