<br />I <br /> <br />I <br /> <br />I <br /> <br />Administration Services during the Construction Phase. Fees for these services are included in <br />the Contractor's Construction Phase Fee. <br /> <br />1.3.2 The Project Architect will assist in the administration of the Contract for Construction as <br />set forth below and as otherwise provided in this Agreement and incorporated in the Contract <br />Documents. Project Architect will not pursue a course of conduct which might jeopardize any of <br />the rights of the City as Project owner under this Agreement. The Project Architect will: <br /> <br />1.3.2.1 Assist the Owner Representative in conducting a pre-construction conference with the <br />Contractor, members of City's staff, representatives of affected utility providers, and <br />federal and state agencies having jurisdiction over the Project (including City inspectors) <br />in order to establish construction schedules and to identify key representatives of the <br />parties and lines of communication. <br /> <br />1.3.2.2 Assist the Owner Representative in ensuring that all applicable permits and approvals <br />have been obtained from the appropriate agencies prior to construction. <br /> <br />1.3.2.3 Have authority to reject work which does not conform to the Contract Documents. <br />Whenever, in the Project Architect's reasonable opinion, it is necessary or advisable for <br />the proper implementation of the intent of the Contract Documents, and with the approval <br />of the Owner Representative, the Project Architect will have authority to require special <br />inspection or testing of the work in accordance with the provisions of the Contract <br />Documents, whether or not such work is then fabricated, installed or completed. The <br />Project Architect will review the work and results of all testing laboratories as required <br />by the Contract Documents. <br /> <br />1.3.2.4 Be a representative but not an agent of the City, as Project owner, during the construction <br />phase, and advise and consult with the Owner Representative and provide progress <br />reports and advice to the Owner Representative in writing; forward the instructions of the <br />City (through the Owner Representative) to the Contractor unless (1) Project Architect is <br />unavailable by telephonic communication or otherwise to issue instructions necessary for <br />the proper progress and acceptance of work; (2) jeopardy to life and/or property exists; <br />and/or (3) lack of instructions and/or unavailability of Project Architect will result in, in <br />the Owner Representative's opinion, harm to the City as Project Owner, in which case <br />instructions may be forwarded directly to the Contractor by the Owner Representative; <br />have authority to act on behalf of the City as Project Owner only to the extent provided <br />herein and in the Contract Documents unless otherwise modified by written instrument. <br />Any instructions issued directly by the Owner Representative to Contractor will be <br />promptly communicated to the Project Architect if the Project Architect was unavailable <br />at the time of issuance of instructions. The extent of the duties, responsibilities and <br />limitations of authority of the Project Architect as the representative of the City, as <br />Project owner, during construction will not be modified or extended without the written <br />consent of the Owner Representative and the Project Architect and with notice to the <br />Contractor. <br /> <br />1.3.2.5 Not have control or charge of and will not be responsible for construction means, <br /> <br />11 <br />
