I I I 1.3.7 Make recommendations for payment that constitute a representation by Project Architect to the City, as Project owner, based on the Project Architect's on-site inspections as provided for herein and on the data comprising the Contractor's application for payment, that the work has progressed to the point indicated; that, to the best of the Project Architect's knowledge, information and belief, the quality of the work is in acceptable conformance with the Contract Documents (subject to an evaluation of the work for conformance with the Contract Documents upon substantial completion, subject to the results of any subsequent tests required by or performed under the Contract Documents, subject to minor variations from the Contract Documents correctable prior to completion, and subject to any specific qualifications stated in the Certificate for Payment); and that the Contractor is entitled to payment in the amount certified. However, the issuance of a Certificate for Payment will not be a representation that the Project Architect has made any examination to ascertain how and for what purpose the Contractor has used the monies paid by the City as Project Owner. In prosecuting this task the Architect will: 1.3.7.1 Determine the amounts owing to the Contractor based on its on-site professional inspections and on evaluations of the Contractor's applications for payment including comparisons of Contractor's monthly cost reports with its applications for payment, and will make recommendations for payment in these amounts, as provided in the Contract Documents, or take such other appropriate action which the Project Architect deems necessary. 1.3.8 The Project Architect, with the approval of the Owner Representative, will interpret the technical requirements of the Contract Documents. The Project Architect will render mterpretations necessary for the proper execution or progress of the Work with reasonable promptness on written request of either the Owner Representative or the Contractor, and will render written recommendations to the Owner Representative within a reasonable time on matters relating to the execution or progress of the work or the interpretation of the Contract Documents. 1.3.9 The Project Architect will consult with the Owner Representative to clarify and interpret the intent and scope of the Contract Documents. Project Architect's interpretations and recommendations will be consistent with the intent of and reasonably inferable from the Contract Documents. Project Architect's interpretations will be made in written and/or graphIc form includmg, if necessary or appropriate, supplemental documents to amplify or clarify portions of the Contract Documents. 1.3.10 The Project Architect will review and make all decisions regarding the approval or taking of other appropriate action upon the Contractor's submittals, including but not limited to, shop drawings, product data and samples, schedule of values and progress schedule, but only for conformance with the design concept of the work set forth in the Contract Documents, and will respond to Contractor's inquiries and questions and provide such supplemental information as appropriate. Such action will be taken with reasonable promptness, but generally not to exceed 15 days or such period of time as will not cause delay of the Project. One copy of each submittal, shop drawing, product data, etc., will be provided to the Owner Representative. 13
