<br />I <br /> <br />I <br /> <br />I <br /> <br />written approval from the City, which approval will not be unreasonably withheld. <br /> <br />1.2.7.2 All drawings, specifications, change orders and other design documents will bear the seal <br />of the licensed professional who prepared them in accordance with the applicable laws <br />and regulations of the State of Texas. <br /> <br />1.2.7.3 Following selection of the Contractor and the assignment of this Agreement by the City to <br />the Contractor, the Contractor will be solely responsible for all obligations to the Project <br />Architect, and will pay for the services of the Project Architect and the approved <br />subconsultants under this Agreement. However, the City will be identified as the Project <br />owner in the Contract Documents, and the Project Architect and the approved <br />subconsultants will acknowledge that they owe a duty of professional care to the City as <br />Project owner for all services provided for the Project. <br /> <br />1.2.7.4 The Project Architect, working with the Contractor, will be responsible for managing the <br />Design Services to help ensure that the Project, as designed, can be constructed for an <br />amount that is within the CCL. The obligation to design the Project so as to achieve the <br />Program objectives of scope and cost will continue through completion and acceptance of <br />Contract Documents. Any adjustment to the scope or quality considered necessary to <br />comply with the CCL or the Program during the design phase will be mutually agreed <br />upon and will be considered normal to that process. The City understands and agrees that <br />the Project Architect's opinion of probable construction cost, as set out in the CCL, is <br />based on the Project Architect's reasonable professional judgment and experience and <br />does not constitute a warranty, express or implied, that the Contractor's cost proposal or <br />the negotiated price or the final price of the work will not vary from the CCL or from any <br />opinion of probable cost prepared by the Project Architect. <br /> <br />1.2.7.5 The Project Architect will submit the names of all proposed sub-consultants for approval <br />by the City, which approval will not be unreasonably withheld. <br /> <br />1.2.7.6 The Design Services will incorporate current technology as appropriate to the stated <br />purpose of the Project and the programmed functional activities that are compatible WIth <br />any existing conditions and acceptable to the City. <br /> <br />1.2.7.7 In the event a material error or omission is found in the drawings, specifications, and <br />other information furnished, the Project Architect will correct the error or omission <br />without charge to the City. <br /> <br />1.2.7.8 City will have the right to reject any defective Design Services or other defective Work <br />on the Project. <br /> <br />1.2.7.9 At each stage of the Design Services, Project Architect will provide the following <br />services as appropriate: <br /> <br />Architectural Services <br />Interior Design Services <br /> <br />7 <br />
