Joe Garza introduced Mr. Roy Sedgewick from the <br />Texas Department of TVater Resources and ~1r. James Hailey and ~1r. Alan I <br />Colwick from the Soil Conservation Service. Mr. Hailey said that <br />historical information was used to establish the floodplain, but not <br />exclusively. Mr. Hailey reviewed the floodplain map for the Council. <br />Mr. Sedgewick said there are no official maps of the floodway area; <br />they will be formally approved later in the year. He said the stadium <br />and Jowers Center were in the proposed floodway. Mr. Sutton asked if the <br />City did not follow the set rules dealing with the floodway, would citizen's <br />flood insurance be jeopardized and Mr. Haley said "yes". The City Manager <br />asked if Council approved the floodway as they designated it, would that mean <br />that no building could be done in the floodway area. Hr. Hailey said that <br />was correct. Mr. Hailey said if a house is removed and a new house put <br />in its place, and it's in the floodway, then the house must be elevated <br />above the 100 year floodplain level. Mr. Tenorio asked if appealing a <br />floodplain decision would jeopardize the program and Mr. Hailey said "no". <br />Mr. Stokes said he felt Council should go ahead and get another opinion. <br />Mr. Stokes made a motion to place this item on the next agenda meeting for <br />a vote and to direct the Staff to report on funding sources for such an <br />appeal. Mr. Breihan seconded the motion which passed unanimously. <br /> <br />The Mayor introduced for consideration an Ordinance on second reading <br />having the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, SETTING RATES OF FARE FOR PASSENGERS OF VEHICLES OTHER <br />THAN AUTOMOBILES WHICH PROVIDE SURFACE TRANSPORTATION ALONG I <br />DESIGNATED ROUTES ADJACENT TO THE SAN MARCOS RIVER AND WITHIN <br />THE CORPORATE LIMITS OF THE CITY OF SAN MARCOS AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />Mr. Cavazos moved the Ordinance be approved on second reading. Mr. James <br />seconded the motion, which passed unanimously. <br /> <br />The Mayor introduced for consideration an Ordinance on second reading having <br />the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES <br />AND RESTRICTS TNE LOCATION AND USE OF BUILDINGS, STRUCTURES <br />AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING <br />OF 4.125 ACRES OUT OF THE T. J.
