Kraus by a Iesolution duly adopted June 23, 1980 herein- <br /> <br />after referred to as City and Julius Sadavsky Advertising Inc., hereinafter <br /> <br />Sadows~, hereby enter into this agreerrent, the terms, conditions and <br /> <br />considerations for which are set out as follows: <br /> <br />1. <br /> <br />Ci ty agrees to allav Sadowsky to utilize city right-of-way for the <br /> <br />location of bus stop benches for the use and convenience of persons utilizing <br /> <br />the Southwest Texas State University Shuttle Bus System. <br /> <br />II. <br /> <br />Sadowsky agrees to pay the city a fixed sum of Ten and no/100 ($10.00) <br /> <br />Ibllars annually for such rights, and in addition, Sadowsky agrees to pay <br /> <br />to City annually at San Ma.rcos, Texas, a sum equal to five per cent (5%) of <br /> <br />the gross receipts received by Sadavsky from advertising appearing on said <br /> <br />renches, said annual payrrent to te made on or before fifteen (15) days after <br /> <br />the 6th day of Decernter of each year during the tem of this contract. <br /> <br />III. <br /> <br />Sadavsky agrees to keep adequate teaks and records and to furnish <br /> <br />certified staterrents of total gross receipts derived from advertising on said <br /> <br />benches upon reasonable request of city. <br /> <br />IV. <br /> <br />Sadowsky agrees to maintain bus stop benches within the city of San <br /> <br />M:lrcos at the locations shown on the attached Exhibit A, incorporated herein <br /> <br />.i.>j.l,t <br />,,'; .~~ for all purposes. Should Sadowsky wish to add any location to or to delete any <br /> <br />I <br /> <br />1l' :' <br />\/',' , <br /> <br />location from this Contract, Sadavsky shall deliver to the Director of Public <br /> <br />Safety an arrEnded Bus Stop Map seven (7) days prior to the date on whlch said <br /> <br />addition or deletion is proposed to tecare effective. "Jithin said seven (7) <br /> <br />day period, the Director of Public Safety shall give written approval or <br /> <br />disapproval or 'shall request in writing further ti.rre for consideration of <br /> <br />said arrendrrent.
