<br />J o~ <br /> <br />105 <br /> <br />regular meeting <br /> <br />august 25, 1980 <br /> <br />page two <br /> <br />CONFORM TO SUCH RULES AND REGULATIONS IN ORDER TO PROCURE <br />THE APPROVAL OF THE CITY PLANNING AND ZONING CO~1ISSION OF <br />THE CITY OF SAN MARCOS; DEFINING TERMS; FORBIDDING TRANSFERS <br />OF LAND WITHOUT COMPLYING WITH THE TERMS OF THIS ORDINANCE; <br />PROVIDING FOR VARIANCES FROM THE PROVISIONS OF THIS ORDINANCE; <br />PROVIDING FOR THE APPEAL OF THIS ORDINANCE; PROVIDING PENALTIES <br />FOR THE VIOLATION OF ANY OF THE PROVISIONS OF THIS ORDINANCE; <br />PROVIDING FOR THE EFFECTIVE DATE; AND PROVIDING FOR THE STUDY <br />AND PASSAGE OF THE ORDINANCE. <br /> <br />Mrs. Norris made a motion to approve the Ordinance on first reading. I <br />Mr. James seconded the motion, which passed unanimously. <br /> <br />The Mayor introduced for consideration the Interim Zoning Ordinance <br />on first reading having the following caption; <br /> <br />AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION AND USE <br />OF BUILDINGS, STRUCTURES AND LAND: DECLARING THE PURPOSE: <br />PROVIDING FOR CHANGES AND AMENDMENTS: ESTABLIHSING AN OFFICIAL <br />ZONING MAP: ESTABLISHING DEFINITIONS: DESIGNATING DISTRICTS: <br />PROHIBITING USE: PROVIDING FOR NEWLY ESTABLISHED TERRITORY: <br />SETTING FORTH USE RESTRICTIONS IN THE SEVERAL DISTRICTS: <br />ESTABLISHING LAND COVERAGE: PROVIDING FOR PARKING: PROVIDING <br />FOR SETBACK: DEFINING NONCONFORMING USES: PROVIDING FOR A <br />BOARD OF ADJUSTMENT: PROVIDING ENFORCEMENTS AND REMEDIES: <br />CLARIFYING CONFLICTING ORDINANCES: PROVIDING FOR A SAVINGS <br />CLAUSE: AND ESTABLISHING AN EFFECTIVE DATE. <br /> <br />Mrs. Norris moved to remove the item from the table. Mr. Cavazos seconded <br />the motion, which passed unanimously. Mr. Cavazos moved to approve the <br />Ordinance on first reading. Mrs. Norris seconded the motion, which passed <br />unanimously. Mr. StoKes requested a worksession be held prior to the third <br />reading of both interim ordinances. Mayor Kraus agreed to schedule such <br />a session between the second and third readings. <br /> <br />I <br /> <br />The Mayor introduced for consideration a budget workshop. The City <br />Manager reported on the Airport Budget. He proposed to amend the budget <br />by placing $4500 of the Directors salary in the General Fund and to take <br />$2918 out of Revenue Sharing Entitlement #12 for matching funds on the <br />Master Plan. This would leave $9859 capital improvements to use for FAA <br />matching funds. Mr. Stokes had a question about overtime at the airport. <br />The City Manager said that the work would have to be accomplished during <br />the regular working hours. <br /> <br />The Mayor introduced for considertaion a public hearing on the 1980-81 <br />General, Utility, Airport and Revenue Sharing Entitlement #2 Fund Budgets. <br />The Mayor then opened the public hearing. Ollie Giles was concerned about <br />the Dunbar renovation monies. The City Manager reported that Staff <br />recommended that this be placed on the second priority list and that <br />possibly the funding could come from Community Development block grant <br />funds not yet allocated. Mr. James said that he wanted the Council to commit <br />funding from another source if it is not going to come from the General <br />Fund or Revenue Sharing. Mr. Stokes said that the concensus of the Council <br />was to accomplish this work. The Mayor then closed the public hearing. <br /> <br />The Mayor introduced for consideration an Ordinance on third and final <br />reading having the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, I <br />TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGUATES <br />AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES, <br />AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING <br />OF BLOCK 1, LOTS 7, 8 AND 9 OF THE N.S. SMITH ADDITION, LOCATED <br />AT 736 SMITH AVE.; (FURTHER DESCRIBED BY METES AND BOUNDS IN <br />THE ATTACHED "EXHIBIT A") FROM "R-l" (SINGLE FAMILY RESIDENTIAL) <br />TO "D" (MULTI-FAMILY). <br /> <br />Mr. James moved to adopt the Ordinance on third reading. Mr. Gonzalez <br />summarized a letter from Mr. Randall Morris indicating action he intended <br />to take in response to concerns presented by Staff. The letter is attached. <br />
