J o~ 105 regular meeting august 25, 1980 page two CONFORM TO SUCH RULES AND REGULATIONS IN ORDER TO PROCURE THE APPROVAL OF THE CITY PLANNING AND ZONING CO~1ISSION OF THE CITY OF SAN MARCOS; DEFINING TERMS; FORBIDDING TRANSFERS OF LAND WITHOUT COMPLYING WITH THE TERMS OF THIS ORDINANCE; PROVIDING FOR VARIANCES FROM THE PROVISIONS OF THIS ORDINANCE; PROVIDING FOR THE APPEAL OF THIS ORDINANCE; PROVIDING PENALTIES FOR THE VIOLATION OF ANY OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING FOR THE EFFECTIVE DATE; AND PROVIDING FOR THE STUDY AND PASSAGE OF THE ORDINANCE. Mrs. Norris made a motion to approve the Ordinance on first reading. I Mr. James seconded the motion, which passed unanimously. The Mayor introduced for consideration the Interim Zoning Ordinance on first reading having the following caption; AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND: DECLARING THE PURPOSE: PROVIDING FOR CHANGES AND AMENDMENTS: ESTABLIHSING AN OFFICIAL ZONING MAP: ESTABLISHING DEFINITIONS: DESIGNATING DISTRICTS: PROHIBITING USE: PROVIDING FOR NEWLY ESTABLISHED TERRITORY: SETTING FORTH USE RESTRICTIONS IN THE SEVERAL DISTRICTS: ESTABLISHING LAND COVERAGE: PROVIDING FOR PARKING: PROVIDING FOR SETBACK: DEFINING NONCONFORMING USES: PROVIDING FOR A BOARD OF ADJUSTMENT: PROVIDING ENFORCEMENTS AND REMEDIES: CLARIFYING CONFLICTING ORDINANCES: PROVIDING FOR A SAVINGS CLAUSE: AND ESTABLISHING AN EFFECTIVE DATE. Mrs. Norris moved to remove the item from the table. Mr. Cavazos seconded the motion, which passed unanimously. Mr. Cavazos moved to approve the Ordinance on first reading. Mrs. Norris seconded the motion, which passed unanimously. Mr. StoKes requested a worksession be held prior to the third reading of both interim ordinances. Mayor Kraus agreed to schedule such a session between the second and third readings. I The Mayor introduced for consideration a budget workshop. The City Manager reported on the Airport Budget. He proposed to amend the budget by placing $4500 of the Directors salary in the General Fund and to take $2918 out of Revenue Sharing Entitlement #12 for matching funds on the Master Plan. This would leave $9859 capital improvements to use for FAA matching funds. Mr. Stokes had a question about overtime at the airport. The City Manager said that the work would have to be accomplished during the regular working hours. The Mayor introduced for considertaion a public hearing on the 1980-81 General, Utility, Airport and Revenue Sharing Entitlement #2 Fund Budgets. The Mayor then opened the public hearing. Ollie Giles was concerned about the Dunbar renovation monies. The City Manager reported that Staff recommended that this be placed on the second priority list and that possibly the funding could come from Community Development block grant funds not yet allocated. Mr. James said that he wanted the Council to commit funding from another source if it is not going to come from the General Fund or Revenue Sharing. Mr. Stokes said that the concensus of the Council was to accomplish this work. The Mayor then closed the public hearing. The Mayor introduced for consideration an Ordinance on third and final reading having the following caption: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, I TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGUATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF BLOCK 1, LOTS 7, 8 AND 9 OF THE N.S. SMITH ADDITION, LOCATED AT 736 SMITH AVE.; (FURTHER DESCRIBED BY METES AND BOUNDS IN THE ATTACHED "EXHIBIT A") FROM "R-l" (SINGLE FAMILY RESIDENTIAL) TO "D" (MULTI-FAMILY). Mr. James moved to adopt the Ordinance on third reading. Mr. Gonzalez summarized a letter from Mr. Randall Morris indicating action he intended to take in response to concerns presented by Staff. The letter is attached.
