<br />I <br /> <br />I <br /> <br />. <br /> <br />I <br /> <br />(5) General Retresentation and Observation During <br />Construct1on: he tnglneer shal I turn1sh general repre- <br />sentation and observation of the work during the construction <br />phase as follows: Review shop drawings pursuant to the <br />General Conditions of the Construction Contract; make <br />visits to the site; review such work of testing laboratories <br />as may be required by the Owner; keep the Owner informed <br />of the progress of the work; prepare change orders as <br />required; review the application for payment submitted <br />by the Contractor and prepare appropriate documents for <br />payment authorization. The Engineer shall use reasonable <br />diligence to detect defects and deficiencies in the work <br />of Contractor and recommend disapproval or rejection of work <br />as failing to conform to the Contract Documents. The Engineer <br />shall not be responsible for the means, methods, techniques, <br />sequences, or procedures of construction selected by the Contractor <br />or the safety precautions and programs incident to the work <br />of the Contractor. The Contractor will remain independent <br />contractors with the Owner, and the Engineer does not guarantee <br />the performance of such construction contracts. The Engineer' <br />shall not be responsible for the acts or omissions of any <br />person (except his own employees and agent) at the Project site <br />or otherwise performing any of the work of the Project. <br /> <br />3. Subsurface Investigations and Laboratory Tests: The Engineer will <br />provide the Uwner w1th adv1ce, when requested, wlth respect to the making of <br />all subsurface investigations, including borings, text pits, soil-resistivity <br />surveys, and other subsurface explorations; however, the making of such <br />investigations and the interpretations of data and reports by special con- <br />sultants are not a part of the services to be rendered by the Engineer, and <br />the cost therefore shall be paid by the Owner. <br /> <br />The Engineer shall monitor and review the work of testing labora- <br />tories and inspection bureaus required for the testing or inspection of <br />materials, etc., for the Project, but the cost of such laboratory tests or <br />inspection shall be paid by the Owner. <br /> <br />4. Boundary and Topographic Surveys: The Engineer will indicate to <br />the Owner the approximate boundaries of land which may be required for the <br />Project. Surveys of the land, the procurement of land, topographic surveys, <br />and services in connection with any proceedings for the condemnation of land <br />are not a part of this contract. The Owner shall pay for costs of surveys <br />and shall compensate the Engineer for services rendered in connection with <br />condemnation proceedings. <br /> <br />5. Compensation to Engineer: The Owner agrees to pay the Engineer <br />for all protess1onal serV1ces rendered under this contract in accordance <br />with the following: <br />
