The City shall use its best efforts to collect wastewater samples from equipment placed by the Consultant to be used in testing for the presence of various nutrients at least twice monthly. The City shall transport the test samples to the testing laboratories where similar tests are conducted for the City's regular wastewater treat- ment plants. The City shall furnish the results of these tests to the Consultant in a timely manner. 6. The City shall handle all samples and conduct all tests in accordance with Standard Methods for the Investigation of Water and Wastewater. It is also agreed that the City assumes no liability for in- jury or property damage losses inflicted upon any non-City-employee visiting or working at the Project site, unless such person is there at the specific request of the City Manager, the Director of Public Works or the Water and Wastewater Superintendent of the Cit~ The City agrees to restrict to the best of its ability the entry of unauthorized personnel into the Project area. Payments to the Consultant by the City as compensation for services as outlined herein shall be made within 10 days of the receipt by the City's Water and Wastewater Superintendent of the Project reports, according to the following schedule~ 1. Upon city approval of construction plans, City shall pay the consultant 10% of the total amount due or a total of $2,200. 2. Upon completion of initial construction, including the greenhouse covers, and startup of o~~rauimn' of the Project pilot plant, the Consultant shall submit a Construction Report outlining the design and construction of the Project facilities, in- cluding alterations made to existing facilities, and detailing the expenses incurred from Project funds to complete the construction and begin oper- ation, whereupon the City shall pay the Consultant 20% of the total amount due, or a total of $4,400. Along with the Construction report, the Consultant shall submit a brief description of experiments expected to be conducted through the end of January 1981. 3. On or about January 31, 1981, the Consultant shall submit a Mid-Winter Report, detailing the experi- ments conducted to date, documenting any further expenditure of Project funds, and outlining the experimental program for the remainder of the period during which the Project ponds are to be covered by greenhouses, whereupon the Ci ty shall pay the Consul- tant a sum of 20% of the lump sum total, or a total of $4,400. 4.
