The City shall use its best efforts to collect wastewater <br />samples from equipment placed by the Consultant to be <br />used in testing for the presence of various nutrients at <br />least twice monthly. The City shall transport the test <br />samples to the testing laboratories where similar tests <br />are conducted for the City's regular wastewater treat- <br />ment plants. The City shall furnish the results of these <br />tests to the Consultant in a timely manner. <br /> <br />6. The City shall handle all samples and conduct all tests <br />in accordance with Standard Methods for the Investigation <br />of Water and Wastewater. <br /> <br />It is also agreed that the City assumes no liability for in- <br />jury or property damage losses inflicted upon any non-City-employee <br />visiting or working at the Project site, unless such person is <br />there at the specific request of the City Manager, the Director of <br />Public Works or the Water and Wastewater Superintendent of the Cit~ <br />The City agrees to restrict to the best of its ability the entry <br />of unauthorized personnel into the Project area. <br /> <br />Payments to the Consultant by the City as compensation for <br />services as outlined herein shall be made within 10 days of the <br />receipt by the City's Water and Wastewater Superintendent of the <br />Project reports, according to the following schedule~ <br /> <br />1. Upon city approval of construction plans, City shall <br />pay the consultant 10% of the total amount due or a <br />total of $2,200. <br /> <br />2. Upon completion of initial construction, including <br />the greenhouse covers, and startup of o~~rauimn' <br />of the Project pilot plant, the Consultant shall <br />submit a Construction Report outlining the design <br />and construction of the Project facilities, in- <br />cluding alterations made to existing facilities, <br />and detailing the expenses incurred from Project <br />funds to complete the construction and begin oper- <br />ation, whereupon the City shall pay the Consultant <br />20% of the total amount due, or a total of $4,400. <br />Along with the Construction report, the Consultant <br />shall submit a brief description of experiments <br />expected to be conducted through the end of January <br />1981. <br /> <br />3. On or about January 31, 1981, the Consultant shall <br />submit a Mid-Winter Report, detailing the experi- <br />ments conducted to date, documenting any further <br />expenditure of Project funds, and outlining the <br />experimental program for the remainder of the period <br />during which the Project ponds are to be covered by <br />greenhouses, whereupon the Ci ty shall pay the Consul- <br />tant a sum of 20% of the lump sum total, or a total <br />of $4,400. <br /> <br />4. On or about April 30, 1981, the Consultant shall <br />submit a Heating Season Report detailing the results <br />
