<br />I <br /> <br />I <br /> <br />I <br /> <br />23 <br /> <br />special meeting <br /> <br />september 29, 1980 <br /> <br />page three <br /> <br />AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION <br />AND USE OF BUILDINGS, STRUCTURES AND LAND; DECLARING <br />THE PURPOSE; PROVIDING FOR CHANGES AND AMENDMENTS; <br />ESTABLISHING AN OFFICIAL ZONING MAP; ESTABLISHING <br />DEFINITIONS; DESIGNATING DISTRICTS; PROHIBITING USE; <br />PROVIDING FOR NEWLY ESTABLISHED TERRITORY; SETTING <br />FORTH USE RESTRICTIONS IN THE SEVERAL DISTRICTS; <br />ESTABLISHING LAND COVERAGE; PROVIDING FOR PARKING; <br />PROVIDING FOR SETBACK; DEFINING NONCONFOID1ING USES; <br />PROVIDING FOR A BOARD OF ADJUSTMENT; PROVIDING ENFORCEMENTS <br />AND REMEDIES; CLARIFYING CONFLICTING ORDINANCES; <br />PROVIDING FOR A SAVINGS CLAUSE; AND ESTABLISHING AN <br />EFFECTIVE DATE. <br /> <br />Mrs. Norris moved the Ordinance be adopted on third and final reading. <br />Mr. Cavazos seconded the motion. Mrs. Norris moved to amend Section 2, <br />E to change "petition" to "statement". Hr. James seconded the motion, <br />which passed unanimously. <br /> <br />Mrs. Norris moved to amend Section 4, 28 to change "retirement" to <br />"rest". Mr. James seconded the motion, which passed unanimously. <br /> <br />Mr. James moved to amend Section 4, 37, a, b & c to redefine dwelling <br />unit, single family dwelling unit, multiple dwelling unit and delete <br />triplex and fourplex definitions. Mrs. Norris seconded the motion, <br />which passed unanimously. <br /> <br />Mr. James moved to amend Section 4, b to add "on one lot". Mrs. Norris <br />seconded the motion, which passed unanimously. <br /> <br />Mr. Stokes moved to amend Section 4, 43 by adding "separate" and <br />"attached to or". l'1rs. Norris seconded the motion, which passed <br />unanimously. <br /> <br />Mrs. Norris moved to amend Section 4, 63 & 66 to change the 5 acre <br />requirement to 3 acres and 20 units or lots (respectively) minimum. <br />Mr. Brown seconded the motion. On roll call, the following vote was <br />recorded: <br /> <br />AYE: Brown, Cavazos, Kraus, Norris, Stokes, Tarbutton <br /> <br />NAY: James <br /> <br />Hr. Stokes moved to amend Section 4, 66 by deleting the definition of <br />modular home. Mrs. Norris seconded the motion, which passed unanimously. <br />Mrs. Norris moved to amend Section 4, 78 by removing "one story in <br />height" from the definition. Mr. James seconded the motion, which <br />passed unanimously. <br /> <br />The Mayor moved to amend Section 5 by having a R-l district to include <br />TH and R-l (S.F.) to exclude TH. Mrs. Norris seconded the motion. <br />On roll call, the following vote was recorded: <br /> <br />AYE: Kraus, Norris, Stokes <br /> <br />NAY: Brown, Cavazos, James, Tarbutton <br /> <br />The motion failed. <br /> <br />Mr. James moved to amend Section 5 by adding Section numbers to index <br />the respective regulations for each district and to remove "industrial" <br />from the PUD description Mr. Tarbutton seconded the motion, which <br />passed unanimously. <br /> <br />Mr. Stokes made a motion to temporarily zone newly annexed property <br />R-l. Mr. Stokes then withdrew his motion. J1r. Stokes then moved to <br />amend Section 8, C by deleting specific uses 4-12. Mr. Brown seconded <br />the motion, which passed unanimously. <br />
